I think in the next codex the phase out rule should stand but slightly change.

When the army gets down to 25% of its original forces, of necrons they would still phase out, however only the necrons with the necron rule would phase out. If units without the necron special rule can't come through the monolith portal or be phased in and out by veil of darkness, how would they phase out?

I like it. Would it be enough to take away the nerfdom that is phaseout though?

I don't fully see the purpose of this because if you're army is at the point where it is going to phase out and all you're left with is non-necrons (Pariahs, Scarabs, Tomb Spyders) you're basically done anyway. Tomb spyders are fairly useless for combat because of their horrid WS and BS and pariahs, while fairly decent, will just get picked off by the presumed heavy weapons left in the opposing armies force (because you obviously didn't get rid of them if you got phased out). And let's face it, scarabs are nothing more than fodder to keep a unit in place for a turn or two.

If you ask me, they should extend more wargear to the units instead.

But that's not the necrons. The necrons, fluff wise, have a one size kills all philosophy. Yea you have specialized units (Destroyers, wraiths) but mostly they are just a variant on the endless horde of carbon(Steel ) copy warriors. They don't specialize gear among squads because that's how necrons operate.

True, but Necrons are also supposed to be constantly evolving to become the pinnacle of evolution so they can conquer over other races so why wouldn't that entail they become better equipped in the process by their Star Gods? But I do understand what you're saying.
