This kind of IP claims is precisely what lawyers like, enough similarity to take it to court, enough differences and date mismatches for it to be difficult to make a final decision, other than an agreement between both parts or something.

Honestly though, I like that companies are investing on sci-fi rats, but boxy helmets, really? It is a very impractical design :|

My post wasn't a troll, I was making a statement (maybe a bit blunt) about the irony (hypocrisy?) of his actions. Maybe GW/FW didn't have a problem with him borrowing their basic concepts. Maybe they did and he cleared it up with them. Who cares?

The point is that they certainly could have if they wanted to. Then he turns around and raises a stink when someone else borrows a similar idea from him. They didn't even do it knowingly, he bought the artwork after they made the miniatures. What's the big deal? I agree with what others have said on his facebook page...worry about making your stuff as good as possible and let the market decide. Especially with such a relatively minor example.

I mean...it's not like they copied the idea of one of his vehicles...

Will you eventually have the .stl files available? I only have a FDM printer, but I'm getting pretty nice results from it. Love the style of the rats. If I could ever get myself back into playing 40K I would definitely field a guard army with your tanks

Yes, that is the weapon set that comes with the kit. He sells a flame tank weapon package as an add on.

First of all I am always open for discussion even if it gets a little rough sometimes. Please dont get me wrong on this.

I have to disagree on several points:
1. I had my IP issues with FW and GW and I changed my designs according to their wishes. Now we are both happy.
2. Nico has stated that is design is based on the drawings. At that time he was stealing the IP from Hannes (the creator of the drawings) I saw these drawings, liked them and bought the rights to make miniatures. So even as he created his miniatures before I did he used an IP he did not own.
3. Yes the topic we are talking about is super small. I mean it is just the design of two helmets. I asked him to chenge thse but he didn't answer at all. (we can now discuss forever if the design of these helmets is unique enough or not. I will not answer on this)
4. I was not aware that Patreon is going to block him completely. My idea was to block only the affected files. But that is up to Patreon. I already asked to change this.
5. Your comparission with the two vehicles is lacking a little bit. To gain IP protection the new idea has to be unique enough to stand out from all the existing ideas. In some cases this is just a small detail like the "hofmeister" corner at BMWs. So the vehicles can look very similar but still are protected. But the overall look of vehicles is not protected. And if you look closely these vehicles derivate in nearly every detail.

Since you asked, I'll respond one more time...

You're requesting specific details because that's the argument you can defend. But that's not the point that I and lots of others on Facebook are making. It's more about the fact that you took lots of design cues from FW stuff and then get all butt hurt about it when the same thing happened to you. Is that guys project really going to have an impact on anything you're doing?

It comes across as pointless, no one in their right mind will ever mistake that guys cyber rats for yours.

Also comes across as very callous; did you really need to stamp out that guy's project? Not a question of your legal rights, it's a question of whether you want to be perceived as a bit of a tool.

I went to great lengths to point out the 'facts' in my earlier post. It's interesting to note that Mortian decided to skip that one in responding.

It's also completely legitimate for Apocloner to point out that even if it weren't legal per se; morality and legality are two different things, and Mortian could easily be within his rights legally and acting badly morally.

Not that I think he has a legal leg to stand on either. Just because the creator of the model admits to taking inspiration from an artwork in no way means that they've made an exact copy of that artwork or breached any IP rights. Which is pretty self-evident in this case, given the many separate differing details I laid out in my last post. An oblong helmet is not a protectable concept, and a court would chuck it pretty sharpish.

We actually know this as a fact, because the other creator is based in Vancouver, the Berne Convention aligns their copyright laws with the US, and this concept was tested in Chapterhouse v Games Workshop. Games Workshop tried to argue that their specific shoulder pads were a protectable concept. It got slated and thrown out in the first wave of obvious non-claims along with GW's claim to own 'Halberds', 'Grenade Launchers', and Roman numerals. Geometric shapes do not qualify for protection, and I've already demonstrated how the two differ in detail. So what's left to claim?

Not to mention that Games Workshop themselves also have an oblong rat helmet in their artwork. Clan Skyre have several such variations.

I'm saying all this as someone who has spent a good few hundred pounds with Mortian and is interested in seeing them succeed as a business.

Is the medium tank transports "turret" movable when everything is fixed together?

And out of personal curiosity: if I would put a GW Ogryn into one of the transports (the assault one, medium tank or crawler) would his head bob out?

Yes, the main "turret " is movable, as are the gun arrays that are part of the optional enclosed back top. I don't have a GW ogryn on hand. But will post a picture with a figure in the back.

As I understand it, it has less to do with when and how it was made, and more to do with what you were employed to do. If you're employed to design tanks, then depending on the specifics of your employment contract any tanks you design, even in your own time, are potentially owned by your employer. Any discussion down that road would be pure speculation without knowing the details of the employment contract in question, though, so wouldn't really accomplish much.

Interesting vehicle. I like the idea of a IFV/APC with the armour of an MBT. I do like the paint job on that one pictured and the weapons options displayed, a lot of choice there.

Quick headsup for those interested: I just received my buggies from the kickstarter as well as a set of heavy ogres. I want to finish some stuff before I get to them, so I have no pictures yet, but from a first inspection of the parts the quality is really good. Crisp details, no warping or deformed parts. So far I have only found one tiny air buble on one Ogre shoe were a rivet should be, but it will be no problem to repair. The Lascannons for the heavy buggy and the roll cages are completely straight, a feat not all resin producers manage.

I'm also very impressed by the quality of the ogre heads, they really look stunning.
Another nice feat: delivery was extremely fast. I ordered Tuesday at 20:00, the delivery service got it Wednesday and delivered it Thursday. I live in the same city, still it's impressive.

I just got the gasmask and drop trooper drivers and am really satisfied. Both look really good and come with a lot of different arms. 10 for the gasmask variant, 6 for the drop trooper. The later is also very slightly slimmer

I hope this is not misplaced here, but as this threat is most likely read by Mortian customers:

I now have ordered 3 heavy and light ogres each and (I don't know if by accident or as customer service) got a 4th light ogre body and arms with the last package. So I have lots of spare heads but miss one turban head to complete that 4th dude.

Does anybody have one spare and want to trade for the others?

I did not buy a walker, but I just finished the Ogres and wanted to share as I'm pretty proud of them (for my painting standard). The Khopeshs are from Kromlech, everything else is from Mortians set.
