If Dakka sold gear from the site they might get a C&D letter for making money remotely from GW IP since there is Games Workshop related discussions on the website.

I don't see how. The Dakka Dakka logo is trademarked and the Dakka web content is copyrighted. If they made a T-shirt with Games Workshop art or something, then it would be a different story.

The argument is a bit more complex than that. We all know that taking a GW bit of art and selling T-shirts with it is a no-no.

We all agree that putting a dakka logo on something and selling it is fine.

But GW could argue that it's the GW IP that draws people to this site (discussions, pictures, reviews) and then selling stuff means Dakka is using GW IP to advertise and sell its own products.

Like making a commerical and playing Beatles songs or showing a picture of Tiger Woods without permission.

Total BS of course but since when is GW legal at all sane?

Fair enough, Kid Kyoto. I guess GW could send a C&D letter, but that wouldn't make it a legitimate complaint. I would hope that they wouldn't, or that someone will have the ability to put GW legal in their place before it comes to that.

It's not fair enough, it's utterly flying rodent gak insane.

But the stuff we've been seeing lately is about as rational.

If that's the real reason I can't find a link to Cafepress on this site, then GW's fear mongering is leading people to an almost Chinese level of self-censorship.

Yes, I agree it's absolutely, ridiculously, disgustingly insane and there's no good reason for it at all. I'm just saying you're right that it isn't too far from some of the things GW has been doing lately, especially considering that Dakka is not a GW website, it's a wargaming website that happens to have a large core of GW players (which is really par for the course, since GW admittedly makes up a large part of the wargaming industry).

But really, Dakka is already generating money from advertising and DCM membership, I don't see why GW would all of a sudden get uppity if they started selling t-shirts and stuff with Dakka's own trademarked logos a little more prominently.
