My mom sells a lot of crap on ebay (mostly my old toys ), and she has been hit a number of times by scammers.. who paypal likes to side with.

I just sent her this info, and she is planning on taking her business elsewhere now.

Just sold a bunch of left over Dust tactic boxes, still in shrink wrap.


2 days after the auction ended he filed a claim saying he never received his package. Resolved it by posting the tracking number.

Then when he got it, he filed a claim saying the item was not as advertised, that they were opened and played with. Threatened me with a negative feed back unless I gave him 50% refund.

Told him his options were to send it back and I would give him his money back plus shipping. Or we can file a claim with USPS if anything was damaged.

He left me a negative feed back.

Good job ebay.

Only if they return the items! I don't know how everyone keeps missing that... so yeah, if they only wanted the items temporarily, they can game the system, but otherwise, they'll be back where they started. They don't get the refund unless they return the items according to these terms.


To add to the Paypal horror stories, a friend had recently liquidated his GW collection. Sold it all off on eBay. One of the buyers who bought a large portion of it reported to Paypal that they were counterfeit. Paypal requested original receipts to prove they were not counterfeit (long since gone...don't know too many people who do keep those). Since he couldn't prove they were not counterfeit - he lost the money and the buyer "destroyed" the miniatures. A good chunk of the items were plastics - and I know very well that none of them were recasts or otherwise counterfeit (I had assembled and painted many of them when he bought them new in box years ago).

He was rather annoyed with the whole thing and requested proof that the miniatures were destroyed...none was provided.

Well again, these new terms state that the items would have to be returned to PayPal and destroyed by PayPal if they are deemed counterfeit, so according to the terms that should not happen in the future.

Not really.

it says:

Further, if you lose a SNAD Claim because we, in our sole discretion, reasonably believe the item you sold is counterfeit, you will be required to provide a full refund to the buyer and you will not receive the item back (it will be destroyed). PayPal Seller protection will not cover your liability.

PayPal doesn't destroy it. In fact, PayPal doesn't want to touch it. They are under the opinion (wrongly) that it is a crime to ship counterfeit goods through the mail. If they deem the goods counterfeit - the receiver is required to destroy them (they used to require proof of that...and might require proof) or deliver them to local authorities (police) for destruction.

Double checked the story with him...

He was told the receiver signed a statement saying he destroyed the goods.

Anyone who would willfully claim real goods are counterfeit would likely sign that letter in a heart beat. Although I have seen counterfeit resin and metal - I have yet to see counterfeit plastic. Pretty sure they buyer gamed the system (and likely has done it more than once too).

I guess I just don't see the issue with the 45 days - or better yet, 45 days from time of shipping. It would help deal with the various issues that come about with long lead time items (sorry - but looking at you Zuzzy) as well as keep the time limit short enough that a seller doesn't get ambushed 6 months after they sold something and have to go back through their records to figure out what it was, who it went to and when it got there (6 months might not seem like much - but for some power sellers, that represents thousands of sales).
