I did media and film as a degree. Trust me on this, we looked into it further than Wikipedia to make sure we obeyed the law for our projects.

Stores are private property, and the owners can set reasonable rules, such as no photography (common in bars), no guns, no smoking, ect.

In the US if they post a sign that says no pictures, and you take a picture, you can be considered 'trespassing' and they can ask you to leave the property. If you refuse to leave, you can be arrested. I don't know if they can have the picture deleted or whatever, but any store, or other privately owned space can do the same thing.


While it's generally not required to ask permission in a public, or publicly accessible space with no reasonable expectation of privacy (such as a store), I certainly would do so if I wanted to take pictures of someone's models. It's really not hard to be courteous.


A store might strictly speaking be private property but courts take into account the fact that the public is permitted on the premises and treat them, for many purposes, as public spaces.

If you want to bar entry or impose conditions on people in a public space, you have to do it according to statute or contract.

Again, you'd have to be a real TFG to kick up a fuss and refuse to quit taking pics/leave, but I don't think they can - legally - actually stop you/throw you out.

Then again, a judge would ream you hard for wasting their time with this de minimis nonsense as a cause of action.

Taking pictures and not leaving would likely just come under harassment laws I would suspect.
It’s not taking pictures that is the trouble, it’s you being an TFG that got you kicked out.
And people won’t like you.

The whole TFG bit is acknowledged and understood. You don't have to tell me each time; I know that it would be extremely unreasonable to behave in such a way and I'm not advocating that anyone should.

Just spitballing on the legals, 'cause my nerd hat has many feathers.

EDIT - Though, even in event of a breach of the peace or a public order offence, the store-owner still can't bodily remove me. Only the po-po could.

I would ask regardless. I've only ever seen someone decline once and they were just angrily packing stuff up after losing a tournament game of wm to a friend who politely asked to snap a photo of the final turn.

If I'm playing and taking pictures of my games, and then walk into frame? I'm assuming you're giving permission, especially if you're actively sitting to watch the game. I'd also have no issues with people taking pictures of my models. It's not like they can use said pictures to take physical ownership of my stuff, and I don't make money off of pictures of my models, so it matters nothing in the long run if someone takes and/or posts pics of my stuff.

In the US - no issue. I can take photos whenever I want. If the guy wants to be weird about it - let him cause a scene. Sounds similar to when cops ask to not be recorded.

As long as the person taking the photos isn't making fun of the paint job or doing anything nasty to the individual.

My friends and I take pictures of each other's models.all the time but we have an understanding as we know each other and have been friends for a long time. It's an unspoken agreement because we all love sharing pictures of games we played with the rest of our group who weren't there, and I'll post games on other platforms my friends have given me pre consent for (though I'll usually still ask).

If it were someone I don't know or just met, the answer is almost always yes but asking would go a long way. If they just upped and took a picture with out asking I that would rub me the wrong way and I would probably stay away from that person despite the fact that I would have said yes if they would have simply asked. It's just common courtesy.

Even in the US I imagine most sane people would simply ask before taking photos of someone miniatures or a game in progress.

People - use some common sense. This is the real world, not the you make da call forum.
If you walk by and snap 1 photo of a cool model - ok sure most people wouldn't even notice BUT it's still polite to ask.
If there's a game in progress and you're trying to take multiple pics OBVIOUSLY you should get their permission first and if one of the players asked you to stop and you started going on about 'muh freedums' and compared them to corrupt cops - newsflash - you're the weirdo.

Had something oddly relevant happen to me like this. I had some of the pictures from my Dakka Dakka gallery used on an ebay listing by a random stranger. I was informed by PM by another member and asked the stranger to not use the pictures as adverts. Still don't quite know how I feel about this.

Agreed. The only reason people take others photos online for sales threads is to scam someone. Maybe they want to pretend they've got something they haven't; or show off painted models that are not their own quality etc... For whatever reason the only reasoning is to scam. Honestly the best thing when you see it is to report it to Ebay or the store in question so that they can tackle the problem directly.

The only models that don't belong to me I've ever taken photos of are contest entries at shows that have explicitly been put up on display. I'd never photograph an ongoing game, my own or other people's. Heck, I genuinely try never to take photographs with recognizeable people in them, either. As someone who dislikes being documented or recorded, I feel like it's the least I can do as a courtesy to the world, in the hopes that it will repay it to me in kind.

The supply does not get to make the demands.

Sure, manner and etiquette are one thing - but those are also niceties or simple social contracts.

This thread is actually an off shoot of the OP stating in another thread he had legal protection against people photographing his miniatures while at a game store, etc. I do chuckle at the "If you don't ask my permission we'll have issues..." kind of responses though. What exactly would said issues be? You going to mouth off or threaten someone because they didn't ask for your permission to snap pictures? Smacks of empty internet chest-thumpery.

I can appreciate obvious etiquette...but I draw the line when people start confusing it with legal precedent or some kind of "right" (a wretchedly abused term in modern language). It's also somewhat damning of people when a lack of etiquette from one party elicits a bizarre over-reaction by the "offended" party.

Say someone snaps a picture of your miniatures without your permission, but your response is "Hey pal, I'm going to punch your teeth in!"....who's the bigger assbag in that scenario?

The etiquette for photography of a game is “Don’t interrupt the game.” And please be aware of the local rules and regulations. :-/

If what you’re doing would interrupt the game, like you want to get a really nice photo of a specific model, then you have to be a nice person and try to politely interrupt.

Disclaimer: Note that there can be a huge difference, legally, between taking a photograph and being allowed to publish it.

But that's not the scenario being referred to as making someone an assbag worthy of some kind of response. It's someone reacting to being asked not to take photos by pointedly taking them anyway regardless because "it's not illegal brah". And yeah even then I'd say decking someone would be excessive, but if you're going to be an obnoxious prat, don't be surprised when someone "accidentally" knocks your expensive camera to the ground and then "unintentionally" steps on it.

Because bear in mind, the arguments people are using to disregard the basic common courtesy of asking permission to do something a non-zero number of people dislike and find uncomfortable and respecting their wishes if they refuse are the same ones deployed by paparazzi, a group generally considered so low that people laugh at them when they get punched and abused, and their targets are celebrities who have even less of an expectation of a private life than some random everyday person.

Well considering i only take pics of my own games in a store i work at., there is no conflict.

If i snap photos of other peoples stuff it is because they asked me to.
