Active user does not matter.
The rule is for Character use only. if you are not a character the rule does not apply to you.

You as the character are entirely passive
You don't use the rule at all

The shooting unit uses the rule to determine if the character is targetable or not.

The rule is simply additional restriction "imposed" on the shooting unit when targeting a model with CHARACTER keyword. It's not a rule that is "used" by anyone, thus breaking the logic behind "shooting unit gets to choose" argument.

Disagree, despite earlier. You have to use the shooting rules in order to, well, shoot. This is a shooting rule.
