This is my first post for a transaction report, so please bear with me if I commit a faux pas. This will be the second transaction report on Mortix, the first was started by Glon52 and appeared to be unresolved. Unfotunately for me, it was started after I made my deal as well. Here is what I got:

14 April Mortix starts a thread to trade several items, mostly space marines items: http://www.dakkadakka.com/dakkaforum/posts/list/289470.page

14 April I send my first PM offering to buy two large green GW cases with strap and some Terminators.

17 April I receive my first response and someone has already got dibs on the cases. I respond that I will wait in case the deal falls through and if it does not, I will still purchase the Terminators at that time.

After two more PMs the last being on 19 April I agreed to purchase the two cases and the Terminators for $165. The money was paid that day through Paypal.

27 April Glon52 starts his thread for a transaction report.

1 May I received an email through my registration account with Paypal explaining that he was out of town on an emergency with relatives in Alabama.

7 May I received another email asking for my shipping address. Address provided in response.

14 May Another email saying he has returned from the family emergency and he was hoping to send through Paypal. Then another saying he would try to bump to priority shipping. Later that day yet another saying he was not able to use the electronic shipping and he would have to do it manually.

Now a short note about me is that I am military stationed outside of the US and I use an APO to receive my mail. APO delivered mail is notoriously slow, so I usually allow for this before I start bugging people about the shipping (most of the time I get querries from the shipper first wondering if it arrived yet). Also, this has been a particularly busy year for me and immediately following the commencement of this deal I had two back to back month long trips away from home with very limited internet access. The most recent of which had me returning the last week of June. When I did return and discovered that this particular package had still not showed up, I sent both an email and a PM asking for information about a status and requesting a tracking number. That was 29 June. Today is 12 July and I am on a well deserved vacation, but I also have someone monitoring my mail in case this showed up, which it has not. On the day I sent those messages out I also looked into other transaction reports and found the one on Mortix. I have already contacted another member from that thread whom I was worried may have purchased some of the same items I did. He already responded and said that although he had paid for them, he had already become frustrated with Mortix that he requested and received a refund.

Although I can really use those cases, I will settle for a refund as it has been almost three full months since the deal was struck, family emergency or no, it is simply too excessive a time frame with the lack of communication we seem to have and the other reported problems with members. I invite anyone that has had dealings with Mortix since 14 April to chime in with any information or their experiences, good or bad, for the benefit of other members. I further invite Mortix to respond to my messages and close this deal one way or another. PM me your phone number and we can hash this out quickly on the phone. I will pay for the call, no problem.

I would suggest given the length of time involved and the seeming lack of communication from the other side, that you should consider opening mail fraud charges. Of course, I would continue to try and resolve this amicably, but you do need to protect your interests at the end of the day.

Other option: get a phone number from the person in question. It usually shows how things are going preeettty quickly.

If the payment is sent through paypal , the seller is obligated to provide proof of them sending the item.
If no proof can be displayed , im sure you'll get a refund.

Use paypal and request a refund case , the paypal company will take the appropriate actions and steps to protect you
( after all thats why they draw service fees )

After a pair of calls to user Mortix, I spoke with him today. He stated he received the package back from customs a while ago and it was sitting around his home. He offered to send it to me while I am on vacation in the US if I supplied the address, which I did. He mentioned putting it in the mail tomorrow and it arriving on Wednesday, so we will see if that happens.

Well, after reading Lunahounds post and reviewing mine, I did fail to state that he mentioned a hospital stay. Mortix, if you are following this, a tracking number would be very useful once you resend the package. It should keep me from bothering you as long as the tracking shows it has not yet delivered.

do tracking numbers work with regular post service internationally? i know when sending OUT of the united states, the tracking stops at the border unless you pay tons to have the delivery signed for.

At the moment I am on vacation in the US and Mortix has agreed to send the package to this address. However, you are correct about tracking to APO addresses ending at the port of transfer (New York for Europe/Middle East and San Francisco for Pacific/Asia).

I hope the information I gave you helps get it settled.

I wanted to point out to the community that Mortix made a deal to sell the cases to both "thedmstrikes" and myself.

I also posted in the "Glon52" thread and after a few threatening Emails to "Mortix" I was returned my entire amount of money via Paypal.

He can be dealt with, although he is/was slow to respond.

It has been another week of attempting to contact Mortix making it two full weeks now since he promised to send the package to me in the US and no package and no answered calls. At this point, I am going to elicit assistance from any members or mods that know Mortix or can put me into definite contact with him. I no longer desire to have the items I purchased and simply want a refund of my money so that I can be done with this transaction. I fully understand the difficulties with shipping to an APO address and I understand that things happen in life that can delay things, but I am unable to abide when a man says he will do domething then not do that thing. It is not a difficult thing to do, especially after I remove the overseas requirement. I do not want any more excuses and I do not wnat to spend any more time talking to his answering machine or leaving unanswered messages in his inboxes. Mods, is he even accessing the website in the last month or so? Thanks everyone for any assistance you can provide and I humbly suggest not dealing with Mortix in the future.

It looks like his last post was 3 months ago, explaining the difficulties he was going through. It's unfortunate that the 45-day window passed, as that's by far the easiest way to get money back. At this point, it would be up to Mortix to refund you, which hopefully he will do if he in was simply unable to send the package.

Saying he will send and then not sending is inexcusable, though... it's much better to be upfront about a delay if there is going to be one, rather than to make excuses after the fact.

I had no trouble shipping to your APO address, but then again I was sending a much smaller package. It is possible that a large box would be turned away or have difficulty getting through, although the fact that the items were sold to two different traders makes that explanation less likely.

Thanks for the update Ritides. I was expecting to hear that he was on the boards just to stay in the loop, but this means he is either incapable or uncaring enough to check back or he is lurking without signing in. In either case, my next message I will leave on his answering machine today will be my request for refund. I had not asked for one yet (I really wanted the cases), but I am not getting any responses from him with the other messages I have left anyway.

Well, it has been awhile now of attempted calls to Mortix and no answer. He has made no replies to either my PMs or my email messages. Given his several false claims of it is in the mail, I promise with no tracking number to back it up and the fact he no longer answers his phone, I have to say this guy. I dealt with him in good faith and made same day payment once we came to an agreement. If he does return to the boards I highly recommend that no members actively trade with him. He had several excuses early on that may or may not have been legitimate, but then he lied to me on the phone, which I can not abide. When I can once again go to the places I want, I will be able to meet Mortix in person and give him a final opportunity to refund my money, after that, well, I know where his local sherriffs office is and we will see if his excuses hold up for him too.

MODs, please lock this thread unless Mortix asks for it to be reopened.

Hopefully he'll do the right thing and get you the cases, before he has to answer to the sherriff about this!
