Can embarked passengers snap shot as overwatch when their transport is assaulted?

This came up in a practice game I did.

I would say no, since you are charging the transport, which is a different unit from the embarked passengers.

I believe there is a part of the rulebook under "transports" that specifically states embarked units can overwatch from a transport

You are assaulting the transport. Only assaulted units can overwatch. The unit in the transport is not being assault thus cannot over watch.
