I mean, choosing to clone X-Wing is still a much, much better idea than trying to finagle your RPG system into a miniatures game.

Isn't the Flight Path System that X-Wing (and Star Trek) uses licensed from Ares (Wings of Glory)?

It is indeed. But you can't copyright systems, only the specific expression of such.

And then there's the issue of actually enforcing it, of course.
