I´m an amateur game designer, and I´m creating a 16bits style platform videogame set in the 40K universe. The game is about a young ultramarine who receive the call of a Khorne demon...
I´m making the game with the Arcade Game Studio, drawing all sprites by myself, but using some free music and sound effects. Here you have some captures of the first two levels:

Haha! Well, that´s why I will make it freeware. It´s a fan-made product. If you give credit to GW, and don´t get profit, I guess you can do anything (I´m not an expert in copyright laws, anyway). It´s like drawing a fanart, or writing a fan-fiction, or making a atman cosplay.

Giving credit and not taking payment are not real factors in copyright issues. The big question is whether the new work is TRANSFORMATIVE or DERIVATIVE. Transformative = good. Derivative = bad.
Additionally, most copyright issues are civil as opposed to criminal. That means you only hear anything if the copyright holder chooses to say something. Just because they choose not to does not stop any other copyright holder or even the same holder from changing their mind and taking issue in the future.
Fan-fiction and commission work have exceptions carved out for them (such as parody).

If you want to avoid a C&D, I think a few tweaks could let it stand on its own - change the "U" to an omega sign by flipping it (ironically, a "flipped" marine turning to chaos...) and maybe rename it "Ultimate Marine"?

GW has shut down freeware versions of Space Hulk in the past. The author of one of those finally had to change the color scheme and change the name to Alien Assault to keep being able to offer it.

Fun game, though also frustrating in places lol. Took me a while to get through the first level, just because you seem to have a 2-hit health system with no way to recharge health (eg. mario mushrooms) and while you seemed to have a checkpoint, there was no visual queue that I noticed that you have reached a checkpoint.
Also on level 2 you have an impossible to pass trap, which will always take 1 damage off you. So if you take damage at any time before that, then you might as well just die and restart because you can't avoid being killed by it. I assume there's meant to be a timing window to pass the trap, but as far as I could tell the timing was flawed.
Might just be me being tired though. Was still fun, but I decided to stop playing because the frustration was getting too high.

You have to press the action button ( A or D ) to pass the intro screens.

It's the second set of green beams, not the first. It's two beams right next to each other, without a gap between them. The pattern goes Left, Right, Both, Left, Right, Both, without any pauses between. So it means there's always one beam turned on, so you can't just run through, and you cant do the usual trick of standing under the left one while its off, then moving under the right one when it turns off, because the left one turns on at the same time as the right one turns off, so you get hit before you can move.
It might be that there is a timing that makes it possible to do it, but I wasn't able to see it last night. Unless the beams cycle like that a few times before a gap appears, but it seemed like a repeating pattern to me.

I'll give it a go, it may have been simply me being extremely tired at the time, but I played through to that point over two continues before giving it up.
I guess there's no password system in place, so I'd have to start from level 1 again. Very old school. Though that was the worst of the old school lol.
Edit:
ok so I played again, and it worked fine. There was a gap in each cycle where neither of the beams turned on. I'm sure this wasn't happening last night though, there was always at least one beam... I'm sure. Fairly sure. Anyway it works fine now. Until I then died to a guy who shot me through two walls, and I ragequit.
