Can the giant chaos spawn be taken by death guard

They will most likely never be in any codex specific detachments.

DG can take them as they share the CHAOS keyword, but they cannot have a bound detachment with giant spawn in them. You could easily bring a heavy support CHAOS detachment with a malefic lord and a few Giant spawn, or an AUX with a spawn.

For a FW model to be taken in a DG army, they at least need to have the <LEGION> keyword.

You should read the FW Chaos Index FAQ. All units in this book (with a few exceptions) can get every Legion Keyword.

I'm not sure where you seem to think the FAQ makes any changes to legion keywords... The FAQ doesn't add <Legion> to any units, but it does add <Allegience> to a couple (which is a totally different thing).

The question was about Giant Spawn, and while they can be taken in a DG army, they have no legion keywords and so you will lose your legion trait if you field one in your DG detachment. You are of course free to put one in a separate detachment of daemons.

So the answer is yes, you can take one in a DG army, but not in a DG detachment. (Unless you want to lose your trait, but that's silly)

Ummm... (checks codex)

Turns out that yes, you can also do that. At 5 power it's not even hard to summon.

Though it does move at 9"-14" a turn, so losing movement for a character for a whole turn might actually mean the spawn would be faster starting on the board. But thats up to you and your deployment, and what else is in your army.

Yeah, you´re right. I forgot that not everything in the book has a LEGION Keyword to interact with the first FAQ question on page 2.

As per the FAQ for the Forgeworld book

You can only choose for a unit to be from the Death
Guard Legion if it has the Nurgle keyword, or if it
has the <Mark of Chaos> keyword and you choose
to replace that with Nurgle. You cannot choose for
a Hellforged Rapier Battery, a Chaos Hellwright or
a Chaos Hellwright on Dark Abeyant to be from the
Death Guard.

So no, you cannot include it as a Death Guard unit. The Giant Chaos Spawn lacks the option to give it a mark or make it a <Nurgle> unit in any way, so it cannot be put into a Death Guard army. It's not a matter of having or not having a Legion keyword option, it's based on being able to have the <Nurgle> keyword.

The short of it is that the GCS is a chaos daemons unit, not CSM.

Well, that only matters for the detachment. You can still include a GCS in a separate detachment if you wanted.

However, you actually can give a GCS the Nurgle keyword, so it would be the same as fielding nurglings. So I don't see any reason why you can't field it in a death guard army.

Which I've just noticed is weird... for other chaos legions, all units in the detachment much be the same legion in order for the legion to get their trait. Death Guard hasn't got that rule. So you can include nurgle daemons in the same detachment as death guard units, and they will still get their trait.

Yeah, I missed that part of the FAQ.

As for being able to include Nurgle Daemons in a Death Guard detachment without loosing the legion trait, I imagine that is the eventual goal for the various cults. I'm willing to bet we'll see the same thing for Thousand Sons and eventually World Eaters and Emperors Children as well, perhaps we'll see an update in the FAQ. Maybe allowing daemons in a Word Bearers army as well, but the other legions wouldn't make sense to include deamons like that in the mix. The Death Guard Codex kinda has the feel of a Nurgle Daemonkin book.
