Ok so I know things such as auras aren't active while in a transport and so some psychic powers would be useless, but is it possible to use powers such as smite while in an open topped transport. Feels a bit like a shooting attack so may be allowed?

It is not. You have to measure to the model to check the range of the power. Please show me how to measure to the model when it has been removed from the battlefield.

The rules are permissive, they tell you what you can do.

They can only do so if the entry says so. Looking at the Ork's Trukk, which is also open-topped, it does not say they can cast psychic powers while embarked, only that they can shoot in the shooting phase. Check whatever datasheet for the transport you're thinking of and see if it says anything about that. If it doesn't, then no, you can't.
