Oh Canada, I thought you were better than this.

Originally I wasn't going to share but oh my what he said was pretty bad.

For those who don't want to or can't read the article linked here is what the Judge said to a woman who was raped*:

"Why can't you keep your knees together?"

"sex and pain sometimes go together"

Referred to the victim as 'the accused'

She was assaulted in a bathroom and the judge asked why she didn't sit lower in the sink so she couldn't be penetrated.

19 of 23 Judges on a council recommended dismissal from the bench.

*"Allegedly" Not sure if case is up again as it seems like there were two aquittals but also that the case was incredibly tainted by the first judge it is hard to tell. Either way not about that specifically but about the dismissal of the judge and why.

Amidst the mists and coldest frosts he thrusts his fists against the posts and still insists he sees the ghosts.

I wonder if there will be a review of some of that judge's previous cases? I can't imagine someone saying those things without being at least somewhat bigoted or otherwise mentally deranged.

Should be, the article mentioned they'd redone the trial that he made those comments in; and that redo had sparked the look at his behaviour later. Yet both trials led to acquittal which is the worst part of this.

While I agree that this Judge is reprehensible and should have been removed, without further facts I can't comment on the acquittal. If the accused beat the rap twice, he very well might be innocent, or just guilty with not enough evidence.

By the looks of the article it was the same judge both times, so I'm not quite sure on it myself.

Which is why I said in the original post it wasn't really about the case but about what we do know ie what the Judge said, which was really quite awful.

The female complainant in the case was mentioned to be "indigenous". Canadians might come off as the super cool, friendly and laid-back cousins of their neighbors in the USA, but there's still quite a bit of work on relations with their natives, or First Nations as they call them. Some consider the natives useless alcoholic welfare moochers (alcoholism and poverty is a problem) - and those that try to get better education are often ostracized by their own for "going white".

The article didn't say if the defendant was also "indigenous" or European, but a judge having a negative opinion on a native woman is nothing odd either way. Unprofessional and rude for sure to voice it.

Man, there is a lot of self righteous talk on these OT forums from Canadians and what constitutes decency. This man was a Judge who is responsible for ensuring law and order within in jurisdiction. I am not even sure how to take this. Its almost like Canadians have problems too.

As far as the way Canada treats its Natives, both of our countries need to find a way to end the prejudice. Pipeline aside, because that story was horribly covered and not all facts were talked about, our whole continent from Texas North needs to really do some real moral inventory.
