Subject: Fight Phase Eligibility

The rules sate that "Any unit that charges or has models within 1" of an enemy unit can be chosen to fight in the fight phase." However, it doesn't say when this check happens (start of the fight phase or when picking a unit to attack).
My question is this:
If one of my units is charged and suffers casualties, if I remove all of my units that are within 1" if an enemy unit (since I choose which models are removed as a casualty), am I then no longer eligible to fight back in the fight phase? This assumes that the charging unit did not consolidate into my unit (e.g. maybe they chose to remain stationary or consolidate into a different (closer) unit. In this case, since I cannot attack in the fight phase, and am no longer with 1" of enemy, that on my next turn that unit can move and function as they normally do (they don't count as having fallen back out of melee).

You make the check each time you revert to step 1 of the fight phase, which is each time a unit has finished resolving their actions within the fight phase.
This is part of why GW stated that Berzerkers who charged get to make both fight phase actions before any enemy units(without a "fight first" ability); they have charged in this turn's charge phase, so when you go back to selecting a unit they are both eligible and must act before the enemy.
