I just this morning learned that you could not use the Counter Offensive stratagem if you are under the effects of "always fight last" because "always fight last" is worded to say that units are only ELIGIBLE to fight after all other units have fought.

So, and I assume that this is the case but I just want to check, can you still use the Counter Offensive stratagem to fight with a unit that didn't charge even if you're still in the 'always fight first' section of the fight phase? i.e. my opponent charges with 3 units, fights with 1, I use counter offensive to fight with one of mine that didn't charge?

This seems intuitively like how it obviously works, but I want to be sure.

Counter offensive stratagem can be used on any "eligible " unit after another opposing unit has fought

Any eligible unit is any unit that is still able to fight (e.g.hasnt already fought) that meets one of the following:
any unit that fights first
Any unit in engagement range that is not subject to a fight first or fight last ability
Any unit that is subject to both a fight first and fight last ability
Some instances of a unit with fight last abilities*


*if your fight last ability does not remove eligibility they can be selected
If your fight last ability does remove eligibility then they are not eligible to be selected until all units that are not effected by a fight last rule have been selected then they can be selected

So yes you can

Add the following paragraph to the end of this Rare Rules entry: ‘Note that the Counter-offensive Stratagem requires you to select a unit that is eligible to fight. This means that if a unit is under the effects of a rule that says that it is not eligible to fight until after all other eligible units have done so, you will not be able to select that unit to use the Counter-offensive Stratagem.’
Note that eligible is the key word here. The newer versions of Fight Last rules use not eligible in their text. Older rules use cannot be selected, which means they are still eligible. In those cases, you can use Counter-offensive to jump in and fight.
