				<description><![CDATA[ I agree with the concensus of the thread.  The casino also had a legal obligation to prevent him from playing.  It may be difficult to legally define intoxication without medical tests done at the time, some states of inebriation are rather obvious but a loophole is a loophole and the casino will have hot lawyers.]]></description>

I think it would be very hard to argue he wasn't intoxicated after that much, even if it was over a period of 17 hours. Also if he can show proof of the 10 drinks prior to arrival.]]></description>

No, I didn't and you know it. I already said they should have denied him loans and stopped him playing. They are clearly in the wrong for that.<br /> <br /> However, you can't hold them responsible for someone choosing to be too drunk to not know when to quit. As I said, they're majorly at fault, but they're not at fault for the clearly wrong choices he made before being too intoxicated, such as not ordering that one too many or not spacing them out better early on or not asking for food(they will bring you snacks at many, at least in the South).<br /> <br /> I agree, he should win for all the reasons put forth, but he does need to be held responsible for what is clearly a drinking problem that lead to being illegally intoxicated in a public area.]]></description>

				<description><![CDATA[ Obviously this case will be settled out of court so we'll never know what the outcome was, but assuming the facts as alleged in the article are true, the casino bears at least some responsibility; just as any other venue with a liquor license is held to be partially responsible if a drunk driver kills or injures someone if it's proven they continued serving that driver who was visibly intoxicated prior to the incident. <br /> <br /> I think he has a good case if indeed, as he claims, he couldn't even hold the cards and was dropping the chips. It doesn't seem like he was able to sign a lawful, enforceable contract the markers would have represented in that state.  But, again, we'll never really know. <br /> <br /> <br />  <br /> <br /> ]]></description>

My view on it is one I went by when living in Vegas, don't take any more money than you're willing  to lose and don't take the means of getting more money if you can help it. 				<description><![CDATA[ I would laugh my ass off if he spent that money and lost.  Consider this, however, I decide I want to go gambling at a casino but want to cover my ass in case I lose.  I make sure that I act a bit drunk  so the cameras can pick things up like me dropping my chips, cards, etc.  If I lose, I go back and say the casino took advantage of my drunken state with no way to prove how sloshed I was except what people recall me acting like or what was recorded by the cameras.  <br /> It's a sweet scam if you can pull it off, but I wouldn't be surprised if this guy's picture hasn't been issued to every casino in Nevada with a ban on him gambling.]]></description>

If he was bouncing all over the place, just taking a sip every now and then from his drinks and just leaving the rest to go to a new table, it would put the hurt to his claim.  How is a casino worker to keep track of someone who is all over the floor getting drinks in different areas is another question. I think in all the time I lived there, I went to a Casino for gambling maybe once a month,if that, and only for double digits in cash.  Other times I went were for shows and events.  I saw people doing crazy insane crap, though, losing buckets of cash on the turn of a card or a roll of the dice.  <br /> It would be trippy actually watching someone losing $60,000 or more in a very short amount of time.  People caught up in the moment didn't really seem to notice the money they were losing until they were down to their last few chips, and then they would have their come to Jesus, oh gak, moment.  ]]></description>

That seems a conflict of interest where it suits them to loan irresponsibly as they can safely win it all back and pin a person down in debt.  Unlike a bank that lends money to someone who loses it, and the bank is out of pocket due to the debtor.  A casino will likely lend to someone who gambles it all back to them anyway.  The casino has lost nothing, risked nothing, and now has gained a person owing them a huge amount. 				<description><![CDATA[ What's interesting to me is how people are thinking purely of the rich idiot, and his actions.  "He acted like an idiot, therefore I have no sympathy, therefore he has no case".<br /> <br /> They are completely ignoring whether or not what the casino did was legal, or morally acceptable.  No matter what people think of how stupidly this guy acted, there are limitations on the legal contracts you can enter in to with people who's mental faculties are impaired.  If the casino wilfully ignored that, it is predatory and illegal and they should not be allowed to benefit from it.]]></description>
