As for what's legal, consider that in the late 80's FASA had a signed agreement for a Star Wars game. Lucasfilm pulled out anyway and left FASA holding the bag after putting in a significant amount of game design effort. Instead of eating a loss, FASA did a quick fluff revision and launched the game anyway as Renegade Legion.

I get so pissed looking at these. I was a month away from owning one - the guy who ran DreamForge had me all lined up to buy a Crusader with a Mortis loadout and then kaput. The Crusader head is identical to the old plastic beetleback Epic warlords, so I was going to swap out the castle for a homemade rounded carapace. ARGHHHH. F'n GW.

Whoops, I last looked at the thread halfway down page 2, then this page..

While they's pretty obviously very very close to Titans in appearance and layout, and that head is taken right from the original Adeptus Mechanicus Titans, they are still different models.

Perhaps what GW really needs is to have someone like HR Giger, or more to the point, Fox take them to court over the Tyranids being ripoffs of the Aliens. I mean, Most of the Warhammer (Fantasy and 40k) IP is ripped off from "inspired by" other stuff, much of which is trademarked IP and pop culture.
