So then the tyrant guard rules say that if their tirant dies before them they get FC and rage, pretty cler so far.
But what happens if on the turn the unit charges the tyrant dies before the guards get to strike, would they get the bonuses for FC, or wom't it apply as they didn't have that rule when they actually charged?

This is answered in the FAQ. In short no, if the tyrant dies in CC they do not get the benefit of FC.

As they didnt have the rule when the unit charged. i would say no, they dont get the bonuses of FC
|

Yes,if at their initiative step they would benefit from FC, they would get it. The BA ruling indicates you check when your turn to strike, not when you charge in.

The tyranid FAQ says no.
Q. "If a unit of tyrant guard, joined by either a hive tyrant or swarmlord, launches an assault in which the hive tyrant/swarmlord is killed before the surviving tyrant guard have struckblows, will they gain Strength and Initiative bonuses due to FC even though they didn't have this special rule at the time they initiated the assault."

Unless of course the Tyrant is killed by a model that is I5, causing the guard to gain +1 I and then never get to swing because you are at I4...
Going lower in initiative (like for a Sang Priest) is never an issue, but increasing it mid combat leads to annoying problems.
