If DeathMarks have a squad marked and that squad charges. The DM have a chance to wound on a 2+ instead of the 5+ correct? Since the Codex would still be the law of the land? Yes they would still hit on a 6.

yes, the marked SR would still take effect on overwatch, but it is still 6s to hit them in the fist place.

You hit on 6's, wound as normal for the unit.
