Lost in the Warp

Long story short: I paid $100 by PayPal to this user, and after reason after reason for weeks of why my purchasd item wasn't sent yet, he stopped responding.

Timeline:

23 Nov 2012 - I contact the user to inquire as to the price of a Baneblade he had listed in a thread for sale.
24 Nov 2012 - User replies, quoting $60 plus shipping of $11.50, as well as giving his PayPal ID. He claims that "[he] can ship Monday". I also inquire as to the cost of a Skyshield landing pad.
25 Nov 2012 - User quotes me $85 plus shipping would be my total, and shipping would be combined.
25 Nov 2012 - User then corrects himself, quoting $15 for shipping "due to the size and weight" for a total of $100. He claims that he can reduce shipping to $12 if he can open them for me. I refuse, and request for them to be left NIB, and provide my mailing address to him.
25 Nov 2012 - I promptly PayPal the $100 over.
26 Nov 2012 - User acknowledges receipt of PayPal transaction, and states "Heading to the post office in a little bit" after I shoot him a PM asking if he received my payment.

9 Dec 2012 - I shoot another PM after not receiving my box yet, asking for an update on the shipment and if he had a tracking number he could give me.
10 Dec 2012 - I shoot another PM asking for updates.
11 Dec 2012 - He replies, claiming that he has been "insanely busy lately". He also claims that his phone was stolen "a little over a week ago" and so he had to use his neighbor's house for internet. Apparently, he couldn't ship because he could not access his PayPal without his phone. He also claims to not remember the password, but will contact PayPal to fix it when he is at school the next day.
13 Dec 2012 - I request for a weekly update from him. He agrees to do that, and states he is trying to ebay off some things to replace his phone. Out of interest and wanting to support a fellow Dakkaite, I ask him for his ebay handle so I could see if there's anything I could auction for. I get no reply to this.

20 Dec 2012 - The person I originally got the package for and was planning to do a project with shifts the timeline up, so I PM the user again to ask if I can get this by the end of January.
21 Dec 2012 - He replies, that he was "trying to get it in the mail tomorrow". I tell him that I need it as soon as possible after he asks if I need him to wait.

Jan 5 2013 - I shoot him another PM after no updates for a long time.
Jan 7 2013 - I shoot another PM asking for updates.
Jan 8 2013 - He replies with a lengthy PM, explaining that his house burned down the night of 23 Dec, and that he lost the house as well as much of his stuff. He claims that he'll try looking through the stuff that survived to see if any of it is there to send to me, otherwise he'll refund me. This is the last I ever hear from him.
Jan 20 2013 - After an overseas trip, I reply with a message offering my help and assistance to see if there was anything I could do to help him through this patch. I did explain that I needed the miniatures soon, however, and appreciated it if I could either get them or a refund back, as I myself was running a very tight budget and could not afford to buy another Baneblade and Skyshield for the project. I get no response.

Feb 16 2013 - By now, it's been a few months since this whole started, and after the fallout of losing that project commission, I'm starting to believe that this user never really intended to sell me the Baneblade and Skyshield, instead scamming me of $100.
Feb 20 2013 - I send another PM requesting a response - if he did not respond, I would post a transaction report.

Feb 26 2013 (Today) - I am posting this transaction report and warning ALL users of Dakka that this once-reputable trader (from the looks of it by his past trades) has literally just ripped me off $100 and stopped communicating after dropping a whole bunch of excuses. I have also opened a PayPal Resolution Center case, however, since it is more than 30 days old, I do not know if this will work. I plan to escalate it to a Claim in 3 days if he does not reply to me.


To give some background, this user has been posting in the Swap Shop on these dates:

There is no possible claim for not being active and not seeing my PMs, because the user was clearly posting on the forums at least four times (bolded) after his last reply to me via PM. My next step will be to explore legal action to be taken against this individual.

I think there is a 30 day limit on paypal, but you should definitely try to claim through them if you can. Could well be too late though. Good luck.

Not trying to highjack this thread but I also had trouble with this once-reputable trader. He still owes me 2 ork bike wheels and 3 ork handlebars for the same bikes, he said he would send them (after complaining about the condition of the stuff I sent him was in, 1st time I had ever got a complaint) then never has. It has been months now.
Also he said he would never deal with me again and never gave me rep, so he seems shady all the way around. I also sent him a ork jet to ease his felt "slight" to just keep the peace and he still was an a$$ so yea I would caution with using this dude.

Just doublechecked the PayPal dispute procedure for you and you have 45 days, or at least you do in the UK...I can't imagine it's any different for the US.

You then have 20 days to upgrade to a claim.

It's all there when you go on the resolution centre.

There maybe a bit more explanation in this thread that may not have been mentioned in your emails. Of course that doesn't excuse not sending the baneblade in the almost month prior to the date of the fire mentioned nor does it excuse posting in the swap shop while ignoring messages about incomplete prior trades/sales. I'd imagine frankly that losing everything (if true) in a house fire frankly puts other things much higher on the priority list than an online trade rep but if he's simply not able to meet his end of the deal then he should simply say so and accept the consequences. Of course, his posts actively soliciting trades for additional figs instead of selling to meet essential needs like rent/food/new clothes after a fire seem mighty suspicious.

I just wanted to add that I too had a very negative experience with Lictors Lovemachine a few months ago. He was infuriating to deal with and I do not recommend anyone trade with him ever.

I as well had a bad experience with lictor. He was very threating along with being inexcusably nasty. I wish you luck getting your money back. This person while having a high rep, is harming his rep. I hope he comes out here to solve the situation and doesn't lose face.

I plan to send those terridons to the guy that was supposed to get them, but I'll still be out the money on shipping the terridons and the price I paid for the tank busters.

Definitely stay clear until he sorts everything out.

Here I am with a set of Terridons that don't belong to me. They were sent to me by lictors_lovemachine in error and I am going to ship them to the user they are supposed to go to, at my own expense.

I am trying to do this favour for someone who's house burnt down and not give him a hard time that he owes me either a refund or a set of tankbustas and his general response is I stand by that people suck.

It makes one wonder what needs to be done to get on this user's good side.

None of you are on my 'bad side' Matt and I didn't write that specifically about you. I don't feel it was necessary for you to post that.

So, I have had limited internet access, but I am here to 'face' the music' as it were.

First off, the need to post non-helpful things to the thread need to just stop. Commenting that you 'heard bad things about me' just isnt helpful and are usely just a fun way to bash people when you are bored. Also, commenting you had a bad trade with someone when they had to file a BTR against you doesn't help either.

I lost my house, ability to go to school and my phone. I have limited access to the internet and absolutely no income. I can only get to the libarary and use it on a first come first served basis. So every few days is all I can manage during the week, but usualy less.

I messaged Enigwolf privately to explain my situation and that I was trying to find a place to live and also the money to pay him back.

I have been working offline with other Dakka and Bartertown users to figure out resolving trades we had in the past.

I have not been posting new items for sale. A friend has offered to sell a large lot of his 40k models to help me with money for laundry and food while I am homeless. Things very hard to do sleeping at the mission or local bridge down the street.

Again, I am trying to resolve this as I have in the past and honestly, the snarky comments aren't necessary, so no further comments to my charavter are needed or necessary.

I can't fully understand your situation or how you're feeling at the moment as I've never had to go through that before.

I am in the process of dealing with the user who the Terridons belong to and I read your post that you believe that people suck.

You took the time to go back and drag dirt up about a three month old trader report to make sure that everyone knows that you think that people suck. Yes, I know it was not a favorable situation with the other trade but what impression to do think you give to me and to those that are trying to give you the benefit of the doubt (including your friend who is selling things for you) when you are professing to the "warhammer world" that people suck?

If you had posted in that thread somewhere along the lines of:
"I know this is probably a long shot, but I'd really like to get a bit of a refund here. My last contact with this user was extremely negative."
Then, yes, okay, I wouldn't have had any issue.

To me, I feel that you are not taking a very good approach to this situation. When you are in the wrong, which you are here, you should be ecstatic that people are willing to give you a break. I'm not banging on your door/contacting the police/etc. to try get my money back. I'm trying to correct your shipping error and paying more out of my own pocket to do so. From the PMs that I've received from another user, I don't think I'm the only one trying to do this.

Not everyone "sucks". As someone with hundreds of good trades, I'd say you should know better that it is the slim minatory of people who do "suck".

I do wish you the best and hope that you'll get back on your feet. And, maybe, in ten years when we're still too old to be doing this and we make another trade, maybe you can return the favour.

Don't know how much this will help but do not file your claim online. Call their customer service and explain the issue to them. Paypal is very helpful on the phone with will almost bend over backwards to help a buyer. Just explain to them that you were in communication with the guy and he was string you along till the 45 days had pass. I believe that they will help you out.

I have done this a few times when someone was trying to rip me off and it has worked for me. Always call Paypal, never do any customer service or claims online.

I appreciate the update, although this could've come a lot sooner than it did. Look, **** happens outside of the internet, and I'm not going to heap more unhappiness or burden onto you since I'm human too, so here goes:

Please rebuild your life first - that's the number one priority. When your life is stabilized again, I expect that you'd hold to your end of the deal and pay me back. Although as warboss stated, this doesn't excuse you from the fact that more than a full month passed when you had the time to send it to me, told me that you were going to send it, but didn't. But let's put that aside for now and keep this in view, alright?
