Can a unit have a dedicated transport that they don't all fit in if they never embark on said transport?

For instance. Could 20 warrior blob have ghost ark or night scythe that they never get into?

Yes.

The rules for dedicated transports in gheneral only have one additional requirement that normal transports dont, and that has to do with deployment.

Individual codexes may place additional restrictions, e.g. "a unit of 10 models or less may take...", so for example a unit of 30 boyz cannot buy a trukk, as their codex says they cant.

Also one question on the dedicated transport.
Can a squad combat squad and still embark all on a dedicated transport, only splitting when disembarking?

So for shooting, if there are firepoints, they could shoot at two different units?

Read the combat squad rules, it explicitly covers dedicated transports.

How does this break DTs?

Build a man a fire, he will be warm for a night. Set a man on fire, and he will be warm for the rest of his life.

"breaking" as in "just become apparent", a la "late breaking news"

The one exception I know of is with ork trukks, since they have a specific restriction.

The Necron Ghost Ark has a restriction on what models may embark.

Dark Eldar have an army wide restriction hidden away on page 91.

It's actually pretty common to have restrictions in the older codexes.

The new dexes seem to be moving away from this, and not all codexes had the restriction even so. Maybe when Orks and DE get redone the restrictions will be removed,

Could be it depends on the author? Orks, DE are both Kelly dexes, for example.

Dark Eldar and Necrons were the last fifth edition codices and are not really that old.

True enough.

At least necrons were written for 6th. DE sure as hades weren't.

Orks are 4th ed.

There are elements in the Dark Eldar codex that shows it was written for sixth edition, at least in part.

Like what, exactly?

6th ed really wasn't kind to DE, and if the designers had sixth ed in hand there were definitely things they should have spotted would be an issue.

Necrons, otoh, were powerful in 5th , and once 6th dropped their rules were obviously designed to mesh with the new edition.

The fact that several of the units have (character) listed in their unit type for one.

I'm looking at my DE codex right now.

Not seeing a single (character) in the unit type in the book. Got a Page reference for the hardcopy codex?

I have no idea if there is a digital DE codex, but if there is that would have been updated to 6th when they released it, or are you just looking at the references in the back of the BRB?

GK had that, DE do not. Some are listed as Independent Character, but none have the (character) tag.
