Hi folks,

friday we had an interesting situation: my Tau enemy had his Strike Squad behind a small ruin (4" width). On the other side i deep striked my SM Captain. When i made my charge the Tau want to use his Laser-Marked Targets statagem. But i pointed out that he must use this at the time i declare my charge and at this point the ruin is between us - so he can't see my captain. An the stratagem says "as if it were your Shooting phase" and in the Shooting phase you have to see the target...

Was i right or was he allowed to shoot at me?

Here is the wording of the stratagem:
WHEN: Your opponent’s Charge phase, just after an enemy unit has declared a charge.
TARGET: One T’au Empire unit from your army that was selected as a target of that charge and is not within Engagement Range of one or more enemy units.
EFFECT: Your unit can shoot that enemy unit as if it were your Shooting phase. When doing so, each time a model in your unit makes a ranged attack, an unmodified Hit roll of 6 is required to score a hit, irrespective of the attacking weapon’s Ballistic Skill or any modifiers. Until the end of the phase, subtract 2 from Charge rolls made for that enemy unit.
RESTRICTIONS: Your unit cannot shoot more than once this turn.

Unless he had non-LoS weapons, you were mostly right. You’d suffer the -2 to charge rolls no matter what, but shooting with most weapons is not allowed.
