Regarding the 'Agent of Imperium' rule (Italized for emphasis)
"You can include one AGENT OF THE IMPERIUM unit in each IMPERIUM (excluding FALLEN)
Patrol, Battalion and Brigade Detachment in your army without those units taking up slots in those
Detachments. "
Does that mean that an Agent of the Imperium can not be the only HQ unit because the Agent is "invisible"/not taking up the slot, and thus can not be the Warlord either? If another HW unit IS included can the Agent be the Warlord then?

A patrol, battalion, brigade detachment requires at least one, or more, HQ unit(s). Its not a legal detachment without HQ(s). So, yes, AGENT OF THE IMPERIUM cant be the only HQ in those detachments, because its not using a slot.

Thank you for the answer - is it still possible for the Agent to be a Warlord in a patrol/brigade/battallion?
I am wanting to put an Inquisitor in with a patrol and have the Inquisitor be the Warlord.

I think you need to make an Inquisition detachment, either Vanguard or Auxillary Support, to have an Inquisitor as the Warlord.

An agent of the imperium does not use a slot so does not count towards the minimum or maximum number of units of that battlefield role.
You can select any character to be a warlord
Some agents of the imperium (primarily the assassins have a rule that prevents them having a warlord trait)
The Inquisitors have no such rule. Or rule that changes this if the are an agent of the imperium or in a seperare detachment.
However their is a 1cp strat that lets an inquisitor have both a relic (unless its a named character) and a warlord trait so often it is more efficient to spend the CP and make a model from your primary detachment a warlord.
(I should also note that inquisitors that are agents of the imperium have access to the inquisition warlord trait and relics not the ones in your primary faction keyword)
