PALM BAY, Fla. — A 21-year-old Saudi woman faces a battery with a hate crime enhancement charge after telling police she spit on several Walmart customers because "Americans are pushing us around."

Terry Rakowski, 39, thought she was being helpful oon when she told the woman in the religious head covering and pink burqa that she was using the wrong door to get into Walmart. Instead, the 39-year-old Palm Bay, Fla., resident said the woman looked at her and spit in her face before she turned and rolled her cart into the store to go shopping.
"She just spit all over me. All I was trying to do was tell her she was coming in through the out door. She was just ramming it into the door," said Rakowski, who was with her husband. "She then looked at me and said, 'Yes I did,' then walked off. … This really bothered me last night. You just don't know what she might be capable of."
Now, Nuha Mohammed Al-Doaifi, a Saudi Arabian national, faces the battery charge with a hate crime enhancement, which means that the first-degree misdemeanor battery charge could be elevated to a third-degree felony bringing a chance of greater punishment if convicted, prosecutors said.
"Her actions were directed at random people based on their ethnicity, and that's according to her own statement," said Yvonne Martinez, spokeswoman for the Palm Bay Police Department.
Witnesses said Al-Doaifi, accompanied by her 2-year-old son, also spit at another customer who apparently got too close to her. The spittle missed in that case, police said.
Workers at the store were notified and immediately called police. Several patrol officers approached Al-Doaifi to talk in the store and asked her why she resorted to spitting at customers.
She was arrested and booked into the Brevard County Detention Center in Sharpes, Fla., where she remained jailed on a $6,000 bond late Monday. Al-Doaifi's family members would not comment on the case.
Al-Doaifi had attended Florida Tech in Melbourne, Fla., but her enrollment ended in spring, officials said.
"She's also had an incident with one of her Florida Tech professors," Martinez said. "She also spit at the professor. They have initiated procedures to have her sent back to Saudi Arabia."

SWMBO is too nice for that, although she might accidently run her over if she were standing by a curb. I count it a food day when driving with her and we don't hit a curb...

I agree with biccat, I don't like with the idea of hate crimes. But I do say good riddance to her. I have never heard of a minority being charged with a hate crime and I am in school for Criminal Justice/Law Enforcement.

Yeah, this is a pretty classic case of hate crime laws being over-applied.
As I argued in the other thread it is worthwhile for the courts to recognise crimes that instil terror in an ethnic group as a more serious crime. Spitting on people doesn't really fit, though.

Yes. That doesn't mean that it is proven, it's merely a CHARGE of hate crime, not a conviction.

When she herself said she did it because she didn't like them based on their national identity she pretty much proved that. She will be tried on battery, not hate. The nature of why she assaulted people determines what level of charges are brought. If she randomly spit on a bunch of people because she doesn't like the color blue it would be a misdemeanor, but she did it because she doesn't like American's, which makes it a possible felony. It is a bit of a reach but it is within the law that spitting in someone's face is assault. The Hate Crime is an enhancement to the charge, not the charge itself so she can't be convicted of the hate crime, only of the battery, so saying she needs to be convicted of the hate crime doesn't really make sense.
My question is why someone who apparently so full of hate fore the country lives here? If she hates Americans to the point of spitting in their face, living in America seems like an odd choice.

Convicting is the result of proving, legally speaking, but there's no confusion. I don't like to make assumptions on cases I know little about until there's been a conviction.

I have nothing against Walmarts or the people that go there, but they are not a crowd to take guff.
Having said that, go to the Walmart in Marshall Texas about 9.00PM. Bring a camera.

Ok, i hate spitting. I hate it more than most things, I would rather get punched in the face than have someone spit in my face. I remember thinking this when reprehensible Senegalese savage El Hadji Diouf spat in another players face for about the 4th time "why not kick his dirty fething ass?"
So, serious question, if it is classed an as assault (rightly so) when someone spits in my face, can i punch them in the fething mouth?
I mean, say I just chin them, and don't kick them when they are down or anything, can I legally retort with a punch? What's the alternative? I mean, I wont spit back, that is what savage people tend to do. I like toi reply with a good gentlemanly smack in the mouth.
And what if its a woman? Does that negate the right to self defense?
This is a serious question, Id like to know where I stand, because if some Muzza spits in my face, I want to be able to give her a few swift digs without risking prosecution.
