Yeah that is odd. I see what you are saying now. The article should have said it was based off of nationality.
She said it was because of "Americans are pushing us around." That implies nationality.
This just doesn't fit:

If she spit on a person because they were Nigerian would it be as difficult to understand why nationality was included? Much like GTA's "Kill all the Haitians" kerfluffle a few years back. Discrimination, bias, and hate aren't just skin tone issues.
I'm not necessarily agreeing with the hate crime enhancement as I'm not a big fan of the idea of increasing sentences based on motivations, assault is assault and we have sentencing for that.

Remember that "not guilty by reason of insanity" carries a sentence of "indefinite" in a mental institution, as opposed to clearly defined sentence lengths for normal convictions.
