A small town at the foothills of the beautiful Cascade Mountains

Two scenarios:

1) I have an Autarch attached to a squad of Warp Spiders.  Because the WS don't have fleet, the Autarch cannot fleet.  However, in my movement phase, the Autarch leaves the squad (moves 2" away).  Can he now fleet in the shooting phase since he is no longer part of the squad?

2) I have a "Fearless" IC attached to a squad of non-fearless unit.  They are assaulted.  The IC loses "Fearless" because he is in the squad.  However, at the resolution phase of the combat, all the other models except the IC are dead!   Does he regain  Fearless, or only once the phase is over since he is "officially" in a non-fearless squad until the next movement phase?

1) Absolutely the Autarch could fleet in that scenario. Once the character leaves the unit why would he not be able to fleet on his own?

2) By the RAW, as soon as the unit is destroyed, the character would revert to IC status. When my opponents agree I play that a character that is part of a unit that is wiped out counts as being part of that unit until the end of the phase (and alll the morale checks are finished)

So in your example the Fearless character would still take the morale check as if he was part of the unit but after that he would revert to being Fearless when (and if) he next regrouped.

A follow up question.

So if the unit that the IC is attached to is completly wipped out during an enemy's shooting phase, does the IC have to take a morale check? Or does he count as an IC at that moment and does not have the check for morale?

That's one of the favorite questions of IG players about their command squads! I used to wonder about that one myself so I'll throw down what I've found and how I play it.

Neither the rulebook nor the relevant codex entry (IG for me) mention anything about "the unit" after it has been destroyed. In other words, the only things the rules mention is that if the IC is the last model standing there after the joined unit/retinue has been killed he becomes an independant character again (also confusing since he always WAS an IC). It doesn't mention anything about the phantom unit needing to take one more morale check as though the IC were the last man alive in the unit. But the rulebook also tells us (not in these words) that he is considered part of the unit he is joined to. So when does the unit stop existing and the IC turn into a free roaming no below 50% morale check making model? By RAW I believe that it is imediately after the last squad member is killed and the IC is left alone. So he wouldn't have to take a morale check because if his retinue is wiped out he is an IC again (per pg38 IG dex) right?

!HOWEVER! I have never seen anyone play this way and the V4 rules don't mention anything quite as tight as that when they deal with units and retinues. A character whose unit is wiped out is free to move to another unit (pg 51BGB) but it doesn't say anything about one last morale check, and doesn't even mention this situation for a non-retinue unit.

I think the best way to play it (which is the way I've always seen it played) is to force the unit to take that one last morale check at the end of the enemy shooting phase before then finally segregating the IC from the phantom unit.
