Situation came up in a game tonight that got a lot of differing opinions. Thought I'd ask for some other opinions.

The situation was this: A Rhino full of Marines was completely surrounded by Tyranids. In the assault phase the vehicle was destroyed. There was no space within 2" of the access points which was not also within 1" of an Tyranid unit. There was also no space within 2" of the vehicle which was not within 1" of a Tyranid unit.

So....

A normal disembarkation is not possible, as the access points were blocked...was an emergency disembarkation possible? There was room within 2" of the hull for the marines, but it was all 1" from one or more Tyranid models. We couldn't find anywhere in the emergency disembarkation rules that stated models had to be further than 1" away from enemy models. That being said, there is a line in the Wrecked Vehicle description that says that any models that cannot disembark are destroyed.

We couldn't reach a consensus in the room (some thought they were dead, some thought the models could go on top of the wreck, etc...) so we settled on putting them within 2" of the hull of the vehicle even though this put them within 1" of an enemy. This put marines in a formation around the gaunts and tyrant/guard surrounding the Rhino. We also agreed that the emergency disembarkation rules stated that the unit that disembarked could not do anything for the rest of the current player's turn...which was not actually a disadvantage.

The entire scenario seemed very awkward. So, what do you all think should have happened?

Under the couch

Page 67, first paragraph, states that you can't disembark within 1" of an enemy model.

The 'emergency' provision lets you bail out without being restricted to the access points. It does not allow you to ignore the 1" limitation. They should have been dead.

They should have been dead. Like coredump said there is no allowance to ignore the 1" limitation.
As an aside, those that claimed that the Marines should be deployed inside the wreck, need to reread the rules. The vehicle doesn't become a wreck untill after (emergency) deployment.

Thanks. The two of us who were playing both thought they should be dead but the opinion of the room was firmly against us. It ended up not mattering as they failed their pinning test and were eaten.

Let's say there was room for them to emergency disembark. The rules say they cannot act for the rest of the turn....so they bail out on their opponent's turn and can do nothing for the rest of it. They get no penalty during their own turn?

That is the way it is written. Seems lame. But then again, it is never defined what is meant by 'can do nothing'. IOW, if you charge them, can they fight back??

I agree with others that they should have been dead.

Now that second question, if they DO get to emergency disembark because there's room, what are they affected by? It says they can do nothing for the turn, so does that mean my turn? Their turn? If it means my turn, what happens if I charge them? Can they fight back even though it says they can do nothing? If they lose combat, can they make a leadership check to run away, since they can do nothing?

Yes, it's very ambiguous, there is no answer yet and I believe it is in Yak's 5th edition FAQ submission thread.

"Turn" is defined in the rules as a player turn unless specified otherwise.

As for what they can do that player turn, I would play that they cannot perform any voluntary actions, just like they had 'gone to ground', but it definitely should be FAQ'd.
