Would it be fair to use the Witch King on Fell Beast in an Angmar army? and if so am I right in assuming the cost would be 325 points?

You can use the Witch King (Epic Hero), but it does not mention Winged Nazgul with a Witch King upgrade...
It's semantics though; as you can always include him as a Mordor Ally.

"Fair" isn't the issue. You can, as mentioned, just bring in the Fellbeast as an ally formation.
Not sure why they didn't included the Witch King on Fellbeast as a part of the army list though. Odd thing to leave out.

looking at my rule book last nite ... I "think" you just it just extra points for the Witch king. It mentions this in the section where the fell beasts are located. but again I was glancing but I think it is just more points which it states on the opposite page of the big picture of the fell beast.

The list says you can take him as part of the army but doesn't say if you can have him on the fell beast or not...

Well, Angmar was destroyed long ago, and there were no fell beasts then. On the other hand, if you are gaming in the Third Age of Middle Earth, there are fell beasts now... tho Sauron did not let them fly by day, or cross the Isen, until he was ready to launch his main attack on the West. Secret weapon, y'know.
From a rules standpoint, it says you "are allowed to chose the following Epic Heroes as though they were part of the Angmar list- the Witch King, the Dwimmerlaik, and the Tainted (see page 163)".
Ringwraiths are on page 163. Winged Nazgul are not on page 163.
So If I were running an Angmar-only list, I couldn't in good conscience take the Witch King on a fell beast.
But if I were including Mordor allies, I would not see a problem with it.

I was thinking the same thing as Achilles and Fellblade re storywise. I have the Witch King on foot which I'll use for srict Angmar armies and I'll use the Fell beast version only if my opponents agree to it (gotta love the figure though... :-) )

Dude; your opponent doesn't have to agree... you can take 25% of your army points in Allies. So long as you play a large enough game you can take the Winged Nazgul upgraded to be the Witch King and there's nothing at all to stop you.
He just can't lead your army is all if you're playing Angmar... as only REMAINING points after buying your Leader and First Company can be spent on Allies.

To beat a dead horse:
The Witch King Epic Hero is part of the Angmar list and can lead your army.
The Fellbeast ridden by the witch king is a legendary formation that an Angmar list can take from the Mordor list as part of their 25% allies. As such it can not be the Angmar leader.
Either option is entirely legal per the rulebook. The only thing to be considered is where the points are spent (from your parent list OR from your allied allotment).

There is no rule, as far as I know, that says your allied heroes cannot use their courage/special rules on the main army.
I know there is a rule like that in Warhammer.
If there is a rule like that, then taking a winged Nazgul might be a concern.
But I don't have the book right now, and I don't remember anything like that, so it's probably moot. I'll just be quiet.
[Edit] The allies rule is on p. 217.
And the picture of the Angmar army, on p. 207, actually has the Witch King on a fell beast in it.

Correct. As long as you can legally take an Epic Hero and legally place him in a unit (No "We Stand Alone") then any company he joins can use his F/C. Although they never benefit from an Epic Hero's special rules, unless the special rule explicitly says it applies to the company or formation he joins.
It's kind of weird, for example, Lurtz has Pathfinder, but if he joins a unit without it, the ability is worthless since he doesn't confer it onto his formation.

Um, i know you can use the Witch-King on a fellbeast because i always use it and i use it in every battle with or without allies!

There are so many problems with that statement I don't know where to begin. Just because you use him in every battle doesn't mean it is legal for you to do so. Rules references, please.
Oh, and by the way- this thread is over a year old. While GW has published an WotR FAQ since the last post, it changed nothing to do with MickA's original question. So I have to ask: why?
