So long story short, my wife is getting harassing text messages from someone we rescued an animal from 5 years ago. Since then my wife has changed her name, moved, and changed her phone numbers.

We find out that the way this person got her new phone number (at the very least) was by asking her uncle to look her up at work. He is a police officer....


Now my gut feeling is that that can not be legal. But I am wondering is there anything I can do about it?

A: Its not legal for Police to use there systems for "favors" like that.

B: I recommend at least reporting it, so its on file somewhere.

C: Unless you have concrete proof that said officer did it, I wouldnt go flashing that theory around. They tend to not like people accuseing one of their own.

D: Save Every text that she gets and if possible record any voice conversations. It will make things easier if you do.

Restraining Order?

It's not illegal for someone to find you after you've attempted to lose yourself, but it may have been illegal if the Officer in question was doing so while on the clock. I doubt that you can pursue that to any end though.

Record and report all of the harassment and see if you can get a Restraining Order put into effect. I'm not sure how that all works, but it sounds like the best thing you can do.

That, or tell the phone company you don't want to send or receive texts anymore. They can remove that service, but its an all or nothing deal.

I think it is illegal for the police to make the results of their official enquiries known to someone outside the department, except in case of a giving evidence etc. It would be in the UK, but US law may differ of course.

I agree with the rest of what jp400 wrote.

In the long run you will need to prove a history of harassment in order to get a restraining order. In the UK, long-term stalking cases are often dealt with under criminal law of assault.

From what I've seen you don't need to have so much of a 'history' of harrassment, so much as you need to convince the judge that the person will not obey your personal request to cease contact with you in the 'present'. If you have the money and the will, you can get a restraining order against pretty much anybody you want in the states; our courts have a high regard for a person's right to be 'left alone'.

Thats seriously irrelevant. This is potentially stalking. Stalking can potentially lead to an extended legal fight or violent confrontation.
