Police: Man arrested before Obama event had loaded gun

By Staff reports

August 11, 2009 8:30 PM
PORTSMOUTH — Police said a man arrested at the scene of President Barack Obama's visit to the city Tuesday was found to be in possession of an unlicensed loaded gun.

Richard Terry Young, 62, of 821 Ocean Blvd. in Hampton, was arrested around 9:40 a.m., hours before Obama's arrival, and charged with the misdemeanor crimes of criminal trespass and carrying a loaded pistol without a license.

Young was found inside Portsmouth High School, where Obama later in the day held his town hall-style forum. Young was detained by the Secret Service and subsequently arrested by Portsmouth Lt. Corey MacDonald. Young was carrying a pocket knife, police said. A subsequent search of his vehicle, parked on school property, revealed a loaded hand gun, police said.

Police said Young is being investigated by the Secret Service for possible federal crimes resulting from the same series of events.

Bail was not immediately set, and Young was in the custody of Portsmouth police on Tuesday night.

Police ask anyone with information regarding the incident to contact Detective Lt. Corey MacDonald at 610-7548, or remain anonymous by calling Crime Stoppers at 431-1199 or (207) 439-1199 or online at www.seacoastcrimestoppers.org.

Forever alone

You can never get rid of the haters.

Before someone else says it: If he wasn't going to try and gun down Obama, then what would he be doing in a school with a loaded gun when there were was nobody else important as him there?

People are like dice, a certain Frenchman said that. You throw yourself in the direction of your own choosing. People are free because they can do that. Everyone's circumstances are different, but no matter how small the choice, at the very least, you can throw yourself. It's not chance or fate. It's the choice you made.

He didn't have the gun in the school with him.

Maybe he was going to go back for it, maybe not. I don't know that the guy's innocent, but I don't think there's enough information to say that he's guilty.

Anuvver fing - when they do sumfing, they try to make it look like somfink else to confuse everybody. When one of them wants to lord it over the uvvers, 'e says "I'm very speshul so'z you gotta worship me", or "I know summink wot you lot don't know, so yer better lissen good". Da funny fing is, arf of 'em believe it and da over arf don't, so 'e 'as to hit 'em all anyway or run fer it.

He probably belongs to a gang , and someone reported him , using the Obama event to add additional trouble.

That explains why he carries a knife yet the gun is not on him.

Here's a better story:

So... the both of you are saying that it is a non story and you have no problems with the fact that a man was trying to sneak a knife into an event that the POTUS was scheduled to be at later, and that same said individual also had an unlicensed handgun in his car which was parked in the high school parking lot. That says a lot about both of your character to me that you see it as a non issue that our President could have come under attack. What if this guy had worked up just a little more nerve and tried to get the gun in instead of the knife? It's not like we have had a rash of mass shootings by individuals in this nation as of late. Last one was what... last week? Yeah... sounds like a non story and nothing to worry about.

It's maybe a story. And it's maybe not.

He wasn't carrying a double-edged knife with a blood gutter. He was carrying a Pocket Knife. A swiss army knife, most likely. And it probably has a nail file, scissors, tweezers, and a toothpick too! Now, it's possible it was a stilleto dagger, but based on his age and description, I don't think it was.

He had a loaded pistol in his car. Which, he shouldn't have. We don't know if he was going to leave it in his car the whole day, or if he was planning to sneak it into the meeting and take a shot at the President. Personally, I doubt he was planning to shoot the President, but I don't know for certain.

(channels Mr. T)
NH doesn't have licenses. Its an open carry state...FOOL!
The reporter got it wrong (surprise). I think he may have violated fed eral limits on weapons near schools.
(MR T mode off)
OMG someone had a pocket knife Oh the humanity! Everyone I know has a pocket knife of some sort. Big damn deal. Children have pocket knives.
Note he was arrested hours before Obama was there. I'd give all of your money that this guy's the freaking maintenance man.

He's definitely guilty of having a loaded weapon in his car on school property (and not being familiar with NH law, I don't know if that's one crime, on school property, or two, add in loaded weapon in vehicle). What is implied is that he was packing heat to put a cap in the CinC (Commander in Chief), but I doubt that (although, I don't know the guy, it's entirely possible he was scouting out the high school to try to smuggle a weapon in. It's also possible he always has a sidearm in his car, even when he goes to the Quik E Mart).

Lets try this again. There is no licensing requirements in NH. Even in Canada, you can't convict someone where there's no crime.

At best goofball legally had the weapon in the vehicle but forgot he had it when he went to the school. Moral of the story-don't give them permission to search your vehicle. But lets not let facts and reality interfere with a good freakout and call to eliminate fundamental rights.

.

(post Edited since I found facts about NH legislation)

The accusation "carrying a loaded pistol without a license ", implied that the crime is the act of loading a weapon at a certain moment or in a certain location, without a license.

By the way, from the "New Hampshire Pro Gun association"

"Q: How do I get a license or a permit to buy a gun?
A: You don’t. New Hampshire doesn’t require you to have a license

Q: Do I need a license to carry a gun?
A: Yes, but only for these two purposes (per RSA 159:4): (1) to carry a loaded handgun concealed upon the person, other than in your home or place of business (where you can do so without a license); and (2) to have a loaded handgun in a vehicle (whether the handgun is concealed or not). "

There you go

Relevant law he violated:

What about federal law, does it restrict where I can carry a firearm in New Hampshire? Yes, it
does, you cannot lawfully carry a firearm in federal courthouses, national parks (on December
10, 2008 the Department of the Interior promulgated a final rule that allows person to possess
concealed loaded and operative firearms in National Parks and wildlife refuges in accordance
with the laws of the state in which the National Park or wildlife refuge is located. 30).The law
allowing carrying a firearm in national parks has since been put on hold when the Brady
Campaign to Prevent Gun Violence challenged the law by suing the National Parks Conservation
Association, et. al. On March 19, 2009 the United States District Court for the District of
Colombia in a Memorandum Opinion issued a Preliminary Injunction enjoining the National
Parks Conservation Association from implementing or enforcing the rule allowing persons to
possess, carry and transport concealed loaded and operable firearms within a national park or
national wildlife refuge.31 Federal law also arguably prohibits carrying a firearm in federal
buildings and potentially New Hampshire school zones which is defined as elementary32,
junior high, and high schools 33 (simply because of the language in R.S.A. 159:6, which

It may also be illegal to ahve a loaded pistol in the car without a concealed carry permit-still checking.

EDIT You're right, if it was loaded he would need a CCl. Thats an interesting law:

With certain exceptions,44 a License to carry is issued by town officials where you reside is
required to carry a loaded pistol or revolver in a motor vehicle or to carry a concealed, loaded
pistol or revolver on your person. See RSA 159:6, 159:4 45.

For what its relevance still is, "not enough information to say that he's guilty" was in regards to attempting to attack the president, not carrying a weapon without a licence.
