Say if the person has a old legion army. Would they be allowed to use just the legion section of the codex like say Emperors Children.
Or would I have to use the awfull new one?

I have a feeling I can't though. D:

If you're playing by the basic rules of 40k, the rules that most opponents will expect, and are the guidelines for most play, then you have to stick with a current codex.

If you're playing a special match or campaign and your opponent and all prospective opponents agree, then you could use the older list.

That being said, I think that Emperor's Children is one of the few legions that the current codex can represent fairly well.

The rulebook never says you have to use the most recent codex, or really any codex at all. You could play with a Flames of War African Theater book if you really wanted (though you'd have some difficulty filling the FoC)

The three Black Reach books I have access to go from "Fighting a Battle" on pages iv and v, a diorama of Black Templars vs Tyrands on pages vi and vii, and a small piece of space marines art on page viii. Page 1 of the rulebook is opposite that.

It has such phrasing under the head "Codexes" as "Each army has a Codex -- its own dedicated book, which contains . . . complete rules for all the models in the force, along with their weapons and wargear"

I have 4 Rulebooks you see (The Hardback, the Collectors Hardback, an AoBR one and a Dissected AoBR one that I cut into separate pages, laminated and made a flip book out of) and I am easily confuzzled

But yes, page viii of the big rulebook has this to say:
Once you have chosen which army to collect, it is a good idea to get hold of the Codex. Each army has a Codex - its own dedicated book, which contains in-depth background details and complete rules for all the models in the force, along with their weapons and wargear. Codexes also contain accounts of great heroes and famous battles, a showcase of miniatures, and an army list that will help you to pick an organised force.

Ok, that means flames of war books are right out. Does it say anything about most recent edition on that page? I can't see GW with their love of soft rules saying that you need the most recent stuff.

Obviously you couldn't roll up to a tournament with the 3rd edition Nid codex, as they typically have lists of what codexes are valid. Even if not, a TO would almost certainly invalidate them.

It is listed in singular. So you could try to convince someone that the older book is refered to, but I doubt you would get too far with that.

It's pretty much in the same realm as playing with a fandex, maybe a tad more likely for the other player to hook in.

If someone who used to play was thinking about getting back in I'd let them use the old codex, for a while at least. Be warned though, I used my 5th edition Guard against 3rd edition Thousand Sons and my guardsmen wiped out a Demon Prince and a squad of Rubric marines in close combat.

Sadly there are no more "legions" so to say. All chaos with the current codex is the same.
