An activist group filed suit in federal court in Oakland Tuesday in a new bid to overturn a controversial 1996 state ballot initiative and restore affirmative action in admitting students to the University of California system.
Proposition 209 banned public institutions from considering race, sex or ethnicity in public education, public employment and public contracting.
George B. Washington, the lead attorney for By Any Means Necessary, which was founded in 1995 to fight the UC Board of Regents' ban on affirmative action, said the suit is asking the court to bar the state from enforcing the proposition as it applies to admissions to the UC system.
Washington, a Detroit-based labor and civil rights attorney, said the percentage of black and Latino students admitted to UC has dropped dramatically since Proposition 209 was enacted.
He said that in 2007, Latino, black, and Native American students comprised 45.1 percent of California's high school graduates but only represented 16.9 percent and 19.9 percent of new freshmen admitted to UC Berkeley and UCLA, respectively.
"This is an outrage and a social explosion waiting to happen," Washington said at a news conference outside U.S. District Court in Oakland.
He said the small percentage of Latino, black and Native American students at UC Berkeley is matched only at the flagship universities of the Deep South states of Louisiana, Mississippi, Alabama, Georgia and South Carolina.
Proposition 209 has been upheld by federal appellate courts, but Washington said "the whole ballgame has changed" because of a 2003 U.S. Supreme Court decision upholding an affirmative action program at the University of Michigan's law school and the dramatic decline of black and Latino students in the UC system.
Proposition 209 supporters couldn't immediately be reached for comment.
As a student who hopes to go to UCdavis to study biology who is white this really gets me worried.
When will people realize that affirmative action is just another word for racism against white people.
Some people say its to give everyone a equal chance but is that true? your giving a guy a place he/she might not deserve just because of the color of his skin?
Isnt this just what mlk fought against? didnt he want people judges on ther chracter not there skin color.

Does anyone ever wonder if the blacks and hispanics who aren't attending college do so because they don't think it's best for them? I mean, we get the number of admissions, but we don't see how many have even applied.
Going to college isn't universally useful; I'm sure there are plenty of white people in the UC system who would have been better off not having gone in the first place.
Anuvver fing - when they do sumfing, they try to make it look like somfink else to confuse everybody. When one of them wants to lord it over the uvvers, 'e says "I'm very speshul so'z you gotta worship me", or "I know summink wot you lot don't know, so yer better lissen good". Da funny fing is, arf of 'em believe it and da over arf don't, so 'e 'as to hit 'em all anyway or run fer it.

Yeah. Never did understand Aff. Action. You MUST hire someone because of their skin color even if it means someone more qualified loses the chance at the job because they are caucasian.
AA IS reverse racism. At least for those not looking at the world through rose colored glasses.

It isn't that simple. If you get into college and get some learnin perhaps you will realize that. If you get in that is.
Indeed. To call it racism "against" white people is so short sighted it shows a true ignorance concerning the overall issue.
Affirmative action, while not being a perfect solution, was instituted as a means to help a class of people that were historically discriminated against due to racism, and as a direct result of that racist discrimination were kept out of better colleges and better jobs. I think a more accurate description of affirmative action would be discrimination FOR black people.
Discrimination isn't necesarily a bad thing, but racism is inherently bad.
Having said that, with all of the advances and advantages that have been fostered in race relations, I'm not sure that affirmative action is still "necesary".

Bill Maher had a great joke about reverse racism in his stand-up that was shown last night; unfortunately its not on the tube yet but here's Wanda's funny take:
Affirmative Action is definitely necessary. It'd be nice to think that since the 1960's that racism and socioeconomic balances would've improved; and while it has, its still very much a white man's America. Systematic racism is prevalent and ever since we got the first black president, racism is on display in such attention-whoring movements like the birthers and Republicans clamoring for the next "Great white hope". Hell even that article the OP listed has some pretty glaring and noteworthy statistical changes.

I can understand both sides of the arguement here, but in the end affirmative action is a bad idea. I had a friend who's dad lost his spot as fire chief because they needed a black man in the spot to make percentage. His replacement did so horrible a job that he was fired within months of being hired. Now I know this isn't always the case, and we can say perfect world but lets look at who are the majorities recently. This new cenus will show that white anglo saxons are by far NOT the racial majority any more in this nation, and to base allowing/hiring somone based on their skin and not their abilities is so far reverse thinking that it actually sets back the minorities now adays. Instead of them knowing "hey I earned this job" people will say they got the job because of their skin thus undermining that employee.

Personally I see it has a bad thing and discrimination. When a person is not hired, or admitted into school based on skin color it is discrimination. To argue otherwise is nothing more than justification.
While 45% of minorities might make up the graduating classes, are they able to attend college? Could they afford it? Do they instead want to go to a trade school or join the military? What are the applications looking like? Since they can not base admission on race i assume the application has no mention of race, nor a photo so they do not know if they are a minority.

I used to be behind the idea but I have changed my mind over the last few years.
The way I see it now is that the only true equality is equality of opportunity. That is that everyone should have access to the same standards of education and should be able to apply for whatever job they wish without having to specify race (or sex or even age for that matter) on any application.
If you want more opportunity for Black people then sort out the crummy state of school in many poor black neighborhoods and make scholarships/grants available to high performers from poor backgrounds.
Forcing a company or university to employ a certain percentage of black (or any other minority for that matter) people is just plain counterproductive and fosters resentment. I doesn't create equality, rather the illusion of equality.

What about being hired based on your relationships with people? Frat brother, Uncle works for someone, friend of a friend, ect ect.
