Are there any times when this rule doesn't apply. I heard once when two armies are just fighting to the death, it doesn't apply, any truth to this?

It is ALWAYS in effect. However, if the Necron player is going first and you get him to phase out point in your turn, and there is no next turn, then they're fine. Because it happens at the start of the Necron turn.

@Shas'O Dorian i dont have the codex a friend of mine plays necron. But it doesn't sound fair that they always get will be back.
@Oshava he told me that in meatgrinder it doesn't apply is meatgrinder what i described in the original post?

As Gwar said, Phase Out will always apply. However, there used to be (and still are) some scenarios where it is extremely difficult if not impossible to achieve. One of these missions involves recycling troop choices such then when a troop choice is completely destroyed it enters play from your board edge again (as if from reserve) on the next turn. For Necrons, this means that you have a constant supply of Warriors to keep your Phase Out from happening.
However, the rule, as stated will always apply. On the Necron player's turn, after rolling all their WBB rolls, if 75% or more of their Necron Models have been destroyed, then the rest of the army phases out.

But if Phase Out occurs at the beginning of the turn, before Movement, then the unit will not have come on by that point - as all reserves not Deep Striking move on from off the edge of the board - then they'll Phase Out as normal.

Phase out occurs after you finish rolling your WBB rolls, including ones rerolled for teleporting through a Monolith. If, at the end of your beginning-of-turn WBB rolls you have no Monoliths on the table or will be unable to teleport any units, then yeah, you'll phase out.

The conditions for phase out can occur at many points within a turn, not just at the beginning, thus, Phase Out can occur during any phase of a turn, not just at the beginning.

I have. No where does it say it's at the beginning of the turn. There are two conditions that need to be met for phase out to happen: all WBB rolls have been made, and the Necron army is reduced to (or below) phase out level. These conditions can occur during the Movement, Shooting, and Assault phase of a turn. I can provide clear examples of each if necessary.

No, it happens once all WBB have been made. That happens exactly ONCE per turn.

I see your argument, TGA, but you're missing something. Say a Necron army is right at their Phase-Out threshold at the beginning of a turn, and makes just enough WBB rolls to keep them around for another turn. Then, in their opponent's Shooting Phase, they lose a Warrior. Do they Phase Out?
NO. Why not? Because that Warrior's WBB roll has not been made. Thus the condition of "all" WBB rolls having been made is no longer fulfilled.

You're missing something. You are correct that phase out doesn't specifically say it happens at the beginning of the turn, but you need to re-read the first sentence under phase out and the first sentence of the 2nd paragraph under we'll be back.
Phase out happens after all WBB rolls are made.
WBB rolls are made at the start of every Necron turn.
Therefore, phase out can only occur in the beginning of a Necron turn.

Case in point:
PO or an Necron army is 10. At the beginning of the turn after all the WBB rolls have been made, the Necron player is left with two units of Warriors and a Lord with VoD. The Lord VoD's himself and a unit of Warriors off the table destroying the unit and Lord leaving just the one ten Warrior unit. All the WBB rolls have been made and the army is reduce to the PO number: 10. Thus, the army phases out.
Similar examples can be shown for the other phases. The wording the codex does not specify a specific time for the PO just a two conditions that need to be met: no further WBB rolls available, and the number of "living" models is at or below the PO number.

Explain to me how all WBB rolls have been made when there are models still on the table waiting for another WBB roll? This is the part of the argument that makes zero sense.

Um, read the example TGA just gave again, Gwar. All WBB rolls HAVE been made; nothing is eligible for a WBB roll, there are no rolls pending, nothing can possibly come back. As such, both conditions are met.
1. The Necron army is below the Phase-Out threshold. Check.
2. All WBB rolls have been made. Check. Nothing can possible make a WBB roll.
As such, yes, the way the rule is worded the Necron army immediately Phases Out.
There is nothing specifically stating that Phase Out happens IMMEDIATELY after WBB rolls have been made, only that it happens AT SOME TIME after WBB rolls have been made. As such, it can happen at any time, as long as there is no way for a WBB roll to be made in the next Movement Phase.

Quoted from an earlier edition of the codex. The CURRENT codex just states two condition need to be met for phase out: all WBB rolls have been made, and the army is reduced to PO number.
