Subject: How political is the Supreme Court supposed to be?
Its extremely political since borking was invented.

The supreme court, being a body appointed by politicians, is exceedingly political. At least in the sense that nominations are used as political footballs by the major parties. It was this way long before Robert Bork was alive, let alone nominated to the high court.
The degree to which the justices themselves allow their beliefs to influence their opinions with respect to cases is a matter of debate.

Its not really a court at all. When they did they sit on issues according to party doctrine rather than the facts of a case.
I find that depressing really.
n'oublie jamais - It appears I now have to highlight this again.

The courts seem a lot more political than their counterparts elsewhere in the world. Here you couldn't find many people that could tell you which party appointed which members, and they rule mostly on technical points of law with little say on matters of political interest. I'm not really sure why that is, it might be that your highest court simply has a lot more influence as your constitution is further reaching than our own. But that's just a guess.
“We may observe that the government in a civilized country is much more expensive than in a barbarous one; and when we say that one government is more expensive than another, it is the same as if we said that that one country is farther advanced in improvement than another. To say that the government is expensive and the people not oppressed is to say that the people are rich.”

I'm not entirely sure how similar the Supreme Court in the US is to the Supreme Court in Aus, or if it's more like our High Court. Either way, I can't really comment. Is your Supreme Court the highest court of authority, the one that deals with issues of the Constitution?

I think I'm going to start a count of the number of times you reference 'dogma', 'doctrine', or 'ideology' as the controlling force behind an individual's reasoning.

You know, doctrine and ideology don't post nearly enough.

It’s their equivalent of our High Court, the final court of appeal with a focus on constitutional review. The US Supreme Court is a lot more active than our High Court, though, and therefore more politicised. I think this is due to the US having a stronger and further reaching constitution.
Supreme Courts in Australia are similar, but at a state level, rather than federal.

We have a Supreme Court for each state here as well, actually.

Yeah, I know. I was just pointing out that confusingly we have Supreme Courts at the state level and the High Court at the federal level.

Thought so, yet am still slightly confused as to the details of inter-state lawmaking in the US. Incidentally, today I went to the Brisbane Supreme Court on a legal excursion. An impressive library, had the case of Mary Queen of Scots there. But the highlight was the GBH case (the Pattel case was on, but had been adjourned before we arrived). We saw CTV footage, several witnesses (most of which had been either too drunk or too dumb to remember anything) and at the adjournment of the day we were priveliged to witness the judge, defence and prosecution discuss possible defences the defendant could use and their legal viability, which doesn't often happen. Anyway, I had fun just listening.
