Also, I should point out.

THIS ARTICLE IS FROM TWO YEARS AGO! THE CASE ENDED FEB 17th 2009

If anyone is interested, he won on almost everything. He was found liable for 2 assaults and 2 intentional inflictions of emotional distress.

For his lawyer's blog post about this trial: http://armsandthelaw.com/archives/2009/02/roger_barnett_c_1.php

Also, please keep in mind this is a civil case, not a criminal one. So, "assault" doesn't mean physically hitting someone. It means threatening to hit someone. Battery is actually hitting someone in civil court.

I think you're missing the key difference here, did you read the example? Simply existing in someone's home (or on their property) is different from actually forcing entry into it (which includes simply turning a door handle or opening a window).

In your base, ignoring your logic.

So we have another case similar to the two border patrol agents who went to jail for shooting a drug trafficker crossing into america?

That's completely pathetic, really pathetic.

That's a very common things to see in civil cases. The jury realizes the defendant committed the act, so they HAVE to award the plaintiff something. But, they feel that is was a very minor deal, so they award a super small amount.
