First you see it, now you don’t. Dr. Phil—or whoever manages the TV therapist’s Twitter account—quickly deleted a controversial tweet this week, which said “If a girl is drunk, is it okay to have sex with her? Reply yes or no to @drphil #teenaccused.”

The tweet was deleted after outrage Tuesday over what appeared to be a trivialization of date rape. Responses ranged from serious attacks on Dr. Phil’s credibility to jokes at his expense. Comedians and feminist bloggers had a field day.

Thinking of it from the other angle, since someone being drunk removes their ability to give consent is it advisable to have sex with someone who is drunk?
Obviously I'm not talking about paralytic drunk , but if someone is well under the weather, is it a wise choice considering you may leave yourself open to a rape charge ?

Will no one rid me of this meddlesome doctor?

Yes it may have been an internet tweet, but it was very clear from the get go that Dr. Phil is planning on doing an episode somewhere down the road on teens being accused of rape due to alcohol or some other such influences. It was an innocuous tweet trying to poll the people that watch Dr. Phil's show. The problem is that people looked at it and said, "DR. PHIL THINKZ RAEP IS COOL" and flew off an otherwise sturdy handle. The tweeted question is no more than any other television talk show host going, "Do you think your child may not be yours? If so send a letter to the Maury Povich Show at..." It's an informal poll that allows these show creators to generate "statistics" to add filler to their show (that some people might believe as credible and validated).

I also would have been interested to see the results of such a poll.

Seaward, d-usa: Is it possible that you're both expressing another variable in the equation but not discussing that part of it. The issue, in my opinion, cannot be resolved by only discussing levels of drunkenness and ability to give consent.

The fact that you have a long standing relationship with your wife changes the situation dramatically. There is a level of proximity, foreknowledge and likeliness of consequences that are different from a date or a college party, say.

And besides, yes, married men have forced their spouses to have sex with them drunk, or not, and it wasn't considered rape until relatively recently.

Maybe it's just my reading of the Tweet (I don't use Twitter so maybe I'm missing some subtle nuance) but it just looks like he was trying to gauge his audience's opinions on a subject. He didn't ask the question in a sensationalist way, he didn't do it in a manner that could be easily viewed as insensitive. It looks like another Twitter spat in a tea cup.


And other Dakka members rushing to judgement on each other on little information to see who can be called a rapist? Is this really the best that we can do?

I agree. Plus if you say that we aren't responsible for our actions while drunk, you're saying that men who commit rape while drunk aren't responsible.
