Nothing. Just like nothing stops you from using the 4ed Cron codex in your games, or from making up your own rules and using them in games.

But pretty much no one well let you play with it. Its just a common convention to use the most recent rules for a unit and the escalation rules are not that.

While it is player consensus to use the most updated rules for stuff, the fact still remains that there is no official rule, however due to its power level, i would still only use it in Apocalypse games and only regular games if the opponent allows it

Now onto a related topic, because it has the same name (and is in the same codex due to Escalation FaQ) as the HS C'Tan could you use it in formations? (E.G Conclave of the Burning one and Star-God)

Those formations ask for "C'tan Shard" which a Transcendant C'tan is not.
