Gonna say, that Joker had already killed about 600 people(that they knew of) plus another 300 or so when he escapes in part 2. If that was a real life killer, I'm pretty sure he'd be given an expedited death penalty, not locked up in Arkham.
The Joker is legally insane though. So that basically keeps him alive by making him ineligible for the death penalty. Why they keep locking him up in the exact same place that he keeps escaping from, though....

Perhaps he's the DC Universe equivalent of Steven Jay Russell? Batman is his Philip Morris.
