Eh. Has anyone killed your Warlord yet? No.

"They're alive" makes most sense to me rather than "they don't exist yet and haven't been killed so how do we know?". Probably no need to make it into Schrodinger's Warlord. Just chat with your opponent and agree what to do.

For me, the joy is in putting some good-looking models on the board and playing out a fantasy battle - not arguing over the poorly-made rules of some 3rd party who neither has any power over my play nor will be visiting me (and my opponent) to ensure we are "playing by the rules"

On the same note. If you use the Stratagem that allows you to buy extra relics for CP, can you then use the Ultramarine trait to try and get those back or no?

Since its pregame it seems kind of gamey, but just checking.
"Whilst your Warlord is alive".

Your warlord is neither alive nor dead pre-game, thus it fails the "Is the warlord alive?" check.

Not true. You have your army list which lists who you have, and none of those have taken wounds yet, so the Warlord would be alive.

You technically don't get your Warlord Trait until just before you deploy, and judging by the Psychic Power section of the core rules (since the term isn't defined anywhere else) "before the battle" also occurs at the same time...so RaW you and your opponent would have roll off and the winner would decide if you use the Stratagem before your Warlord Trait is chosen or not.

That is probably a whole other can of messy worms.

You actually pick your warlord after you muster your army (BRB pg 186), which comes before you deploy your army (per the sequence on all the missions). If "before the battle" means "immediately before deploying" (as implied by the psychic powers section), then you have your warlord trait before you use the stratagem.

So the question really is "do models count as 'alive' after you muster your army but before the battle starts?" and it's a question the rules really don't answer conclusively either way. The closest analogue I can find is a unit in reserves, and I think most people would let a warlord in reserve benefit from the trait. Based on that I'd lean towards being able to use the trait on pre-battle stratagems, but there's really no RAW answer. Until there's an FAQ, discus with your opponent or ask the TO.

On a side not I found curious while looking things up on this, since a model that flees doesn't count as slain (per the Index Xenos 1 FAQ), this means if you somehow have a warlord with the appropriate trait flee from morale, you can still benefit from the warlord trait afterwards.

While it is true that you pick your Warlord when mustering your army, the paragraph following that sentence says you don't get to pick your Warlord Trait until immediately before either side deploys.
