Near as I can tell from reading through the rule book and the recently posted TK Review on GW site:

Ushabti = Monstrous Infantry and have Stomp, Ranks, and Support rules

Tomb Scorpion = Monstrous Beast and have Stomp and Swiftstride

Bone Giant = Monster and has Thunderstomp

It was the Scorpion we were having issues with here as far as what it actually counted as since it's labeled a "construct" in the TK book. Getting to use Stomp is nice, but if I can swiftstride with these bad boys, there may not be a reason to use from below.

The Gatling Guns have flamethrowers on them because this is 40k - DOW III

It is a monstrous beast Construct, meaning it follows the Construct crumbling rules.

rememebr you still cannot march, meaning "from below" is still useful - it places you in exactly the same postion as before as regards pursuing faster.
