Hope someone can help with a rule in regards to using command points during the genestealer phase.

I know you can use command points at any time during the stealer phase and the rules also stipulate that a marine player may use a command point after a genestealer performs an action in line of sight to the marine player wishing to use a CP etc.. The situation that played out during yesterdays game was that during the stealer phase i had my Librarian on over watch and he advanced a GS two squares into CC and performed a roll to attack and i at that point said ok i will use 2 CP to change to guard mode.

Is this a legit move or do we need to resolve CC first before i can use any CP i just find the rules contradict them selves abit there.

The step forward once space and attack is a single action for the GS costing 1 AP, so you cannot interrupt between the move and HtH attack.

By guard mode do you mean Overwatch? I think you have to go into overwatch during your own turn. Command points can be used to clear jams and restore overwatch during the GS turn.

It would be a bit late to go into overwatch after a GS has attacked a marine, you only get to fire at models that are moving in LOS in overwatch, not performing actions like attacking or opening doors. The exception being that opening a door or attacking+killing a marine exposes them to LOS of another marine. But once into HtH the marine have to fight it out with their powerglove, they don't get to fire at the GS every time it attacks.

Each move is separate. He needs to give you time between each move to announce if you are using CP. If you do not announce you are using, he goes to the next action. After the next action you may also use CP - and on and on.

It really goes faster than it sounds. Just have a plan and do not take too much time deciding to spend CP's.

He moved 1 space - at this time you could spend CP.

He moved a 2nd space at this time you could spend CP.

He made an attack - After the attack is resolved(the attack is one action), you may spend CP.

Please note: move and attack are separate actions.

If he uses his free 90 degree turn during a move it is not considered a separate action. If he spends AP's to make additional turns, you make spend CP's after each additional turn.
