I played my nids against a necron army the other day, and my after the game, he was saying that his scarab swarms crafted by a tomb spyder did not count as kill points, as the 5th ed faq said they dont, but my spawned gaunts via the Tervigon did count.
Is this right? It seems like complete hypocrisy.

The Necron FAQ doesn't say they're not worth KP... it says they're not worth any Victory Points. Which would only be an issue if you are playing a game that uses Victory Points.

In a KP game, the Scarabs aren't themselves worth a KP because they form a single unit with the Tomb Spider. You would have to kill the Spider and all of the created Scarabs for a KP.

The Tervigon, on the other hand, creates a completely new and separate unit, and the Tervigon's rules specifically state that all scenario special rules apply to that unit. So they will be worth a KP.

Insaniak has it perfectly correct.

The Tervigon creates new units, the Tomb Spyder does not.

It is not hypocrisy at all.

So the scarabs are a bonded unit and therein must maintain cohesion with the unit? Because my opponent detached them and sent them forth as though they were a seperate unit.

Then he was doing it wrong. The Scarabs have to stay with the Spyder.

The whole point of spawning Scarab swarms with a Spyder is to use them as ablative wounds, so they don't NEED to move fast. They catch krak missiles and lascannons aimed at the Spyder. Spyders are Fearless, so never don't even have to worry about Morale tests when their little scarabs go "pop!".

And as long as he only spawns a single base, the unit effectively becomes a T6, W5 Monstrous Creature that can have a 4+ cover save (with good positioning) and gives his warriors a WBB boost. Nasty critters.
