If I cast gift of chaos on a Space Marine on a bike, what toughness does he use, 4 or 5? I'm a little confused because the (5) is his toughness all the time unless testing for instant death. Now I know gift doesn't inflict instant death, but wou;d this use the models "base" toughness? Or their "current" tougness?

Their current, modified toughness, as the test does NOT say "unmodified toughness" anywhere.

Nos is indeed correct. A model with a Toughness of 4(5) uses Toughness 5 for ABSOLUTELY EVERYTHING except determining if you suffer Instant Death or if a special rule says otherwise.
