Yeah, so I saw this a few months ago and did some searches for the answer but didn't find anything.

This guy at the FLGS had some Chaos marines outside a rhino and his HQ on a bike. The HQ 'joined' the squad, then the squad mounted in the rhino, then they went tear-asteroiding through 'Nam. All the while the Chaos player kept saying that his biker HQ couldn't be targeted since it joined the squad, now in the rhino.


I wasn't playing the game and didn't say anything but... really, REALLY? Is that legal?

No, it's not legal.

Page 66, "Transport Capacity" ... 2nd paragraph.
"... The entire unit must be embarked on a transport if any part of it is - a unit may never be partially embarked or spread across multiple transport vehicles."

So the unit can only board the transport if the entire unit climbs in... and since bikers can't board rhinos, that's not possible, so the unit can not embark.
