In the rule book its states in the shooting part that weapons with a strengh double the targets toughness cause instant death, fair enough but what about in close combat eg. space marine captain with toughness 4 fails a save from a ork warboss with a power claw (so strengh 10!) would the captain suffer instant death?

Yes, since the str is double his oughness he will be ID. All wounds removed by ID is added to the combat resolution as well.

If you read the assault section it tells you to use the shooting section for dealing wounds, allocating them and so on. Meaning the ID section is just as applicable there as in the shooting phase.
Yes, a marine captain is generally dead if S4 / 5 models wielding powerfists get too close.

thank you both for such quick replys and for helping clear that up  . looks like my poor captains going to get cut up alot (mainly because i'm so so SO POOR at making saving throws lol) but at least sending in my terminaters in to punch f**k out of some nobz should be fun

Stick a stormshield on him, if you can; then you can at least be making a 3++ instead of a 4++! Relic blades and stormshields are a good combo, making the best use of your high initiative.

his the aobr captain so stuck with bolter/Power sword but thanks for the tip i've got some spare storm shields so will strongly consider that combo when i next buy a captian.

As a note of caution - I'm not 100% sure that combo is legal for vanilla marines, as I dont have a codex in front of me and my memory can deceive me at times. Check your codex before building

Combo is legal, for the Aobr captain it is a simple modeling: cut the bolter off(don't worry if you really hack up the model while doing this); then cover the area the bolter was in with a suitable storm-shield looking piece. The power sword the AOBR captain has is both already very long, and has a 2-handed hilt.
For some ranged ranged support on that model add an auxiliary grenade launcher(any tube devise would work, I used IG Sentinel Smoke launchers for mine)

sounds good but I spent a long time painting him up (check my gallery to see him ) and just couldn't bare to cut him up lol
