Does this really depend on the TO? Or is there some way that we can pretty much know that the Nightspinner is generally accepted and allowed to be used in the tournament since it has an "official" GW stamp on it from their site. Not sure if that holds any weight...

It is up to the tourney organiser, Its a simple as that.

If a unit is in an official codex than its probably a given, outside of this it is entirely at a TO's discretion. A TO could conceivably even rule that Space marine armies are not allowed.

Technically, as TOs have the final word for their tournament, EVERYTHING is up to the TOs. You'll have to ask them.

At our local one it has to be in a current codex (not a WD or IA book) to be valid.

Tournament legal varies a lot from place to place.

The Viletide: Daemons of Nurgle/Deathguard: 7400 pts
Disclples of the Dragon - Ad Mech - about 2000 pts
GSC - about 2000 Pts
Rhulic Mercs - um...many...
Circle Oroboros - 300 Pts or so
Menoth - 300+ pts

I would ask the TO upfront. It *should* be legal as it is a published rule on the GW website, same as if you do not own the Daemonhunters or Witch Hunters codex.

The only "hobby" GW is interested in is lining their pockets with your money.

Chiming in with ask the TO as well. Bring your Army Builder printout and PDF that says that it't legal as well. I have yet to have a single tourney or player have an issue with it, but I keep a 3rd fire prism gun on me just incase. Seeing that, most people prefer to face the Night Spinner

There is a pdf of it up on GWs website to download now, as well.

Best bet, as everyone else has said, is to confirm with the TOs before the event.

I'm OVER 50 (and so far over everyone's BS, too).
Old enough to know better, young enough to not give a ****.

That is not dead which can eternal lie ...

... and yet, with strange aeons, even death may die.

A tournament organizer could not allow certain codexes if they want. In the end, its their event and they can allow or disallow whatever they'd like.
