Here's an odd issue that came up at the weekend.

Three Tyranid Warriors (I 5) with lash whips attack 7 Harlequins (I 6), but only make it into base contact with three of them. RAW would imply that the three Harlequins in contact now have initiative 1 due to the whips, but the other four have their usual initiative. This makes the combat order:

I6: 4 Harlequins
I4: 3 Warriors
I1: 3 Harlequins

If the warriors manage to kill 3 Eldar, can the ones not in base contact be removed in order to let all of the init 1 guys attack next?

You can remove models form anywhere in the unit, and in fact is better to take from models that can not attack or that have attacked already.

Look under P.39 under 'Allocating wounds' for more info on this.
