He cannot as he lacks the Independent Character rule.

Makes sense however justicar thawn is a infantry character just like crowe and yes it does say he is bought for an upgrade to the unit. So what exactly makes it that crowe cant?

Crowe is an HQ choice, not an upgrade Character like Thawn.

Crowe is not an upgrade character. He is his own unit that is purchased from the HQ section. Thawn is an upgrade character that replaces the Justicar.
