If an Ork mob is 20 strong and is reduced to 9 models (but a Bigmek has joined them in a previous turn) making them 10 can they regroup as per the 50% squad rally rule or do they still count as 9 from the original unit?

Let's assume the unit is 20-strong when the Big Mek joins them. They would then be considered 21-strong for the purposes of having to take morale tests for 25% casualties in any phase. If they fail a morale test when the unit consists of 9 boyz and one Big Mek, they are below 50% (roughly 48%), and therefore may not test to regroup.

Check out the BRB FAQ, it states ICs do not count towards the size of unit for regrouping.

The original question didn't really specify whether the IC had joined before or after they started falling back. But yes, that would be a potential issue with trying to 'boost' their numbers by joining an IC to them. Along with it just not working that way anyway...

The squad is already running away. Joining it is a bad idea, because, EVEN IF it did count, you would have to TEST for it first...

It's a bad idea because you may not join units that are falling back.
