Me and my friends were having a discussion about the end result of a game we had.

We played capture and control. At the end of the game only one objective had a scoring unit (DE wyches) within 3", however there was also an enemy unit (Ork lootas) within 3" but this unit was in a higher level of the ruin and could not see the objective.

Was this objective contested?

Line of sight to the objective is not required to contest, just that a member of the unit be within 3".

If they were directly on top of the objective they'd contest, but otherwise they wouldn't, as the default height of ruin levels are 3", no matter how high/low they really are.

EDIT: On top of as in on top of it but one level higher.
